AN ACT AMENDING REPUBLIC ACT NUMBERED FOUR THOUSAND ONE HUNDRED SIXTY-FIVE ENTITLED "AN ACT CREATING THE NATIONAL COMMISSION ON CULTURE AND PROVIDING FUNDS THEREFOR".
Be it enacted by the Senate and House of Representatives of the Philippines in Congress assembled:
Section 1. Section one of Republic Act Numbered Four thousand one hundred sixty-five is hereby amended to read as follows:
"Section 1. In order to implement and carry out effectively the Constitutional provision that arts and letters shall be under the patronage of the state, there is hereby created a National Commission on Culture, hereinafter referred to as the Commission, to be composed of a Chairman and ten (10) members, who shall be appointed by the President of the Philippines with the consent of the Commission on Appointments. The Director of the National Library, Director of the National Museum, Chairman of the National Historical Commission, Commissioner of National Integration, and the Executive Director shall be Ex-Officio members.
"In the appointment of the members of the Commission, every form of Philippine Arts and letters, namely: music, drama, painting, sculpture, literature, architecture, and the dance, shall have one representative each; three Members shall represent the public who shall be chosen from those known for their love and devotion to arts and letters and for their management, business, investment or fund-raising ability.
"The full-time executive Director of the Commission shall serve for a term of twelve (12) years with a compensation of twelve thousand pesos (₱12,000.00) per annum. He shall be appointed by the President with the consent of the Commission on Appointments and shall be a citizen of the Philippines, from 35 to 50 years at the time of appointment, have a Master's Degree or its equivalent, and experience in management and/or working with groups involved in the arts, letters, or other related cultural activity.
"The Chairman and members of the Commission shall serve for a term of six years and shall receive a per diem of fifty pesos (₱50.00) for actual attendance of the meeting of the Commission but not to exceed five hundred pesos a month: Provided, That the Chairman shall be entitled to representation, allowances not exceeding ten thousand pesos (₱10,000) per annum: Provided, finally, That the first five members to be appointed under this Act shall serve for a term of three (3) years and the other five, for a term of six years.
"After the Chairman or any member of the Commission shall have served his full term, he shall not be reap-pointed except after a period of three (3) years and in the event that a vacancy occurs by reason of expiration of the term of the Chairman or member, there will be no holdover.
"For administrative purposes, the Commission shall be under the supervision of the President of the Philippines."
Section 2. Section two, paragraph 15 of Republic Act Numbered Four thousand one hundred sixty-five is hereby amended to read as follows:
"15. To organize a program of research and training and help establish workshops with a view to the revival of traditional and/or indigenous folk arts, music, and dance and distinctively Philippine arts and crafts and to make use of and extend assistance to such institutions as may now be engaged in pioneering work or as may be best qualified to participate in such program in order to provide training and laboratory facilities for both amateurs and professionals engaged in creative literary and artistic endeavors;"
Section 3. Section three of Republic Act Numbered Four thousand one hundred sixty-five is hereby amended to read as follows:
"Section 3. Subject to the approval of the Commission, the executive director shall organize an administrative and research staff, fix the qualifications and requirements for the positions to be created and their corresponding salaries and appoint the personnel that may be deemed necessary to carry out the work of the organization. Not more than thirty per cent of the funds available to the Commission, at the time an annual budget is prepared, shall be devoted to administrative purposes."
Section 4. This Act shall take effect upon its approval.1a⍵⍴h!1
