DECLARING AS ECO-TOURISM PARK AND CAMPSITE PURPOSES, A CERTAIN PARCEL OF LAND OF THE PUBLIC DOMAIN SITUATED IN BARANGAYS LUBIGAN AND MORIONES, SAN JOSE, TARLAC

Upon recommendation of the Secretary of Environment and Natural Resources, and by virtue of the powers vested in me by law, I, GLORIA MACAPAGAL-ARROYO, President of the Philippines, do hereby declare a parcel of land of public domain containing an area of approximately TWO HUNDRED SEVENTY EIGHT (278) HECTARES situated in Barangays Lubigan and Moriones, San Jose, Tarlac, for eco-tourism park and campsite purposes, under the management and administration of the Provincial Government of Tarlac, subject to the provisions of Executive Order No. 111 dated June 17, 1999, existing laws, rules and regulations of the Department of Environment and Natural Resources (DENR) and those which may hereinafter be enacted, subject to vested rights, if any there be, which parcel of land is particularly described as follows:

TECHNICAL DESCRIPTION

A parcel of land within Timberland, Tarlac, Project No. 9, Block-B, Land Classification Map No. 619, certified on October 18, 1926, situated in Barangays of Lubigan and Moriones, Municipality of San Jose, Province of Tarlac. Bounded on the NE by A & D, ISF areas and Kabuhayan 2000., SE by A & D and ISF areas., and NW by A & D and ISF areas beginning at a point marked 1 on the sketch plan, Project 9-A, L.C. Map 1125 and Community Base Forest Management Project of Timberland Tarlac project No. 9, Block-B. being N 08 deg.12W., 2,572.97 meters from BLLM No. 22 Tarlac Cadastre, thence;

containing an area TWO HUNDRED SEVENTY EIGHT (278) hectares, more or less. All points referred to are indicated on the Sketch Plan are marked on the ground by concrete monument 12.70 x 12.70 cms. (top) by 25.48 cms. (base) x 45.72 cms. High under L.C. Map No. 1125, certified on October 18, 1926 of the Land Classification of the Department of Environment and Natural Resources and that date of the Sketch Plan, January 20, 2004; subject to precise survey.

The area herein declared as Eco-Tourism Park and Campsite shall be subject to the following conditions:

1. That at least 50% of the land reserved for eco-tourism site shall be planted to trees and other perennials, preferably of indigenous species, and maintained as a forest park by the Provincial Government of Tarlac;

2. No cutting of trees shall be allowed without prior permit from the Department of Environment and Natural Resources;

3. The development of the area into eco-tourism site shall be subject to Environment Impact Assessment; and

4. The creation of Eco-tourism Management Board composed of representatives from DENR, DOT, two NGO representatives and that Provincial Government of Tarlac who shall act as Chair to formulate policies that shall govern the implementation of the Tarlac eco-tourism Park and campsite.
