[ EXECUTIVE ORDER NO. 70, October 02, 2024 ]
PROMOTING THE DEVELOPMENT OF THE PHILIPPINE FILM INDUSTRY, STRENGTHENING THE FILM ACADEMY OF THE PHILIPPINES FOR THE PURPOSE
WHEREAS, Section 17, Article II of the Constitution declares it a policy of the State to give priority to, among others, arts and culture, to foster patriotism and nationalism, accelerate social progress, and promote total human liberation and development;
WHEREAS, Section 15, Article XVI of the Constitution mandates the State to conserve, promote, and popularize the nation's historical and cultural heritage and resources, as well as artistic creations;
WHEREAS, Section 2 of Republic Act (RA) No. 11904 or the "Philippine Creative Industries Development Act: provides that the State shall promote and support the development of Philippine creative industries by protecting and strengthening the rights and capacities of, among others, creative firms, artists, creators, workers, and stakeholders in creative industries;
WHEREAS, Executive Order (EO) No. 640-A (s. 1981), as amended by EO No. 513 (s. 2006), established the Film Academy of the Philippines (FAP), under the oversight of the Department of Education (DepEd), to: (a) give due recognition, awards, distinction and other forms of reward for the significant efforts and accomplishments of motion picture arts and sciences in the country; (b) further professionalize the Philippine Film Industry through formation of representative guilds in various creative and technical sectors; and (c) maintain educational programs, scholarships, grants and other forms of assistance, through which qualified and deserving persons with exceptional talent and ability in the film arts shall be afforded better opportunities for further development;
WHEREAS, to maximize the full potential of the Philippine Film Industry, it is imperative to ensure that world-class Filipino talents in the field of motion picture arts and sciences are given due recognition and assistance by the National Government;
WHEREAS, it is necessary to strengthen the FAP and further define its duties and functions to complement the programs, activities, and projects of existing government bodies involved in the promotion and development of the Philippine Film Industry; and
WHEREAS, Section 17, Article VII of the Constitution vests in the President the power of control over all executive departments, bureaus, and offices and the mandate to ensure the faithful execution of laws;
NOW, THEREFORE, I, FERDINAND R. MARCOS, JR., President of the Philippines, by virtue vested in me by the Constitution and existing laws, do hereby order:
Section 1. Reorganization. The FAP is hereby placed under the administrative supervision of the Department of Trade and Industry (DTI).ℒαwρhi৷
The FAP shall be governed by a Board of Trustees ("Board") which shall be composed of the following:

The Chairperson, who is also the Director General, shall be appointed by the President, and shall have the rank of Undersecretary. The Chairperson should possess technical and creative expertise in the various fields of motion picture arts and sciences. The Chairperson shall be in-charge of managing the day-to-day operations of the FAP, and shall be assisted by six (6) immediate support staff pursuant to the Civil Service Commission and Department of Budget and Management (DBM) Organization and Staffing Standards and Guidelines.
The FAP shall elect among themselves a Vice-Chairperson who shall assist the Chairperson and Co-Chairperson in the performance of their duties and functions.
The PSRs shall be appointed by the President upon the recommendation of the Chairperson and Co-Chairperson. The PSRs shall come from reputable representative guilds, organizations, and/or associations in the Philippine Film Industry.
The existing units of FAP shall be reorganized consistent with the new structure provided under this Order, subject to existing laws, rules and regulations. In this regard, the current officials and personnel of FAP, if any, are hereby directed to immediately turn over all properties and assets, as well as necessary documents and information, to the FAP Board herein created.
Section 2. The National Film Awards. The FAP shall have the primary function of giving due recognition to outstanding motion pictures, artists and relevant stakeholders with the end in view of revitalizing and further promoting the Philippine Film Industry.
In this regard, the FAP is hereby directed to establish and organize a prominent annual National Film Awards which shall recognize, promote, and celebrate world-class talents and outputs of Filipinos in motion picture arts and sciences. The awards categories, criteria, mechanics, and prizes for the National Film Awards shall be determined by FAP, subject to existing laws, rules and regulations.
The FAP may collaborate with the Metropolitan Manila Development Authority, Cultural Center of the Philippines, and such other relevant government agencies relative to the establishment of the National Film Awards.
In addition, the FAP is hereby authorized to establish an independent committee for the selection of official Philippine nominee/s to the Academy Awards or the Oscars and other similar international awards, subject to existing laws, rules and regulations.
Section 3. Capacity Building, Educational Programs, Assistance, and Other Incentives. Consistent with RA No. 11904 and RA No. 9167, the FAP shall collaborate with the DepEd, TESDA, FDCP, Commission on Higher Education, and Philippine Creative Industries Development Council, as well as the private sector, academe, and such other relevant government agencies, in the provision of programs, trainings, and other forms of support towards the welfare and professionalization of film workers in the Philippine Film Industry.
Section 4. Convergence. The FAP is hereby directed to guide, assist, and steer representative guilds, organizations and/or associations in various creative and technical sectors towards the professionalization of the Philippine Film Industry. In this regard, the FAP may consult representative guilds, organizations, and/or associations or invite them as resource persons, as may be necessary, for the effective implementation of this Order.
As may be necessary, the FAP shall likewise collaborate and coordinate with international organizations and other relevant govenrment agencies and offices, such as the FDCP, NCCA, Department of Tourism, Department of the Interior and Local Government, Movie and Television Review and Classification Board, Intellectual Property Office of the Philippines, and local government units, with the end in view of professionalizing and promoting the Philippine Film Industry.
Section 5. Authority to Accept Assistance and/or Donations. The FAP is hereby authorized to accept donations, contributions, grants, bequests or gift from domestic or foreign sources, for purposes relevant to its mandates and functions, subject to existing laws, rules and regulations.
Section 6. Organizational Structure and Staffing Pattern. The Chairperson shall determine the organizational structure, appropriate staffing pattern, and corresponding qualification standards for all positions in the FAP, and submit the same for review and approval of the DBM, subject to existing laws, rules and regulations.
Pending the approval of the organizational structure and staffing pattern, the FAP may lap into the existing personnel of its member-agencies to ensure the effective implementation of this Order.
Section 7. Implementing Guidelines. The FAP shall issue the necessary guidelines for the effective implementation of this Order, which shall include the following, among others: (a) guidelines for the selection of the PSRs; (b) other duties and functions of the officers of the FAP Board; and (c) rules for the conduct of meetings of the FAP Board.
Section 8. Funding. The funding requirements for the initial implementation of this Order shall be charged against the current and available appropriations of the member-agencies of the FAP. The DBM is hereby further directed to identify other appropriate funding sources to ensure the effective implementation of this Order.
The funding requirements necessary for the continued implementation of this Order shall be included in the budget proposal of FAP and its member-agencies, subject to the usual preparation process.
Section 9. Separability. If any part or provision of this Order is held unconstitutional or invalid, other parts not affected thereby shall continue to be in full force and effect.
Section 10. Repeal. All orders, rules and regulations, and other issuance or parts thereof which are inconsistent with the provisions of this Order are hereby repealed or modified accordingly.
Section 11. Effectivity. This Order shall take effect immediately upon its publication in the Official gazette or a newspaper of general circulation.
