REPUBLIC ACT No. 4668
An Act Granting to J.M. Lontoc a Franchise to Construct Structural Improvements for Commercial Use Over Such Portion of the Estero De San Lazaro-de la Reina in the City of Manila as Has Been Leased to Him by the National Government
Be it enacted by the Senate and House of Representatives of the Philippine Congress Assembled:
Section 1. Subject to the provisions of the Constitution and the conditions provided in this Act, there is hereby granted to J.M. Lontoc, for a period of twenty-five years from the approval of this Act, the right, privilege and authority to construct structural improvements for commercial use over such portion of the Estero de San Lazaro-de la Reina as has been leased to him by the National Government: Provided, That such structural improvements shall not in any manner prevent, obstruct or otherwise impair the free flow of water in the said estero.
Section 2. The plans and specifications of the structural improvements to be erected over the Estero de San Lazaro-de la Reina shall conform with the Building Code of the City of Manila and shall provide such features and devices as will ensure not only the safety and convenience of the people availing themselves of the facilities offered by the grantee, but also the cleanliness and sanitary condition of the waterway: Provided, That the plans and specifications shall also be approved by the Department of Public Works and Communications and the National Planning Commission.
Section 3. The grantee shall hold the national and city governments harmless from all claims, demands or actions arising out of accidents or injuries and damages, whether to persons or property, caused by the construction of the structural improvement or the operation of any facility therein by the grantee.
Section 4. The grantee shall be subject to the payment of all national and municipal taxes due on all improvements he will construct as well as on any business he may undertake therein or in connection with said improvements.1avvphi1
Section 5. This Act shall take effect upon its approval.
