REPUBLIC ACT No. 4541

An Act Amending Certain Sections and the Title of Republic Act Numbered Twenty-Nine Hundred Eighty-Three, as Amended

Be it enacted by the Senate and House of Representatives of the Philippine Congress Assembled:

Section 1. Section one of the Republic Act Numbered Twenty-nine hundred eighty-three is hereby amended to read as follows:

"Sec. 1. Subject to the conditions imposed by this Act, there is hereby granted to Constante Ibaviosa, his heirs and assigns, hereafter referred to as the grantee, a franchise to construct, operate and maintain an ice and cold storage plant in the City of Manila and suburbs for the purpose of manufacturing and distributing ice and supplying cold storage therein and to charge and collect a schedule of prices and rates for the ice and cold storage so furnished, which schedule shall at all times be subject to regulations by the Public Service Commission of its legal successor."

Section 2. Section four of the same Act is hereby amended to read as follows:

"Sec. 4. This franchise shall continue for a period of fifty years from the date said ice and cold storage plant shall be placed in operation and/or shall commence the manufacture and distribution of ice in the City of Manila and suburbs, and is made subject to the express condition that the same shall be null and void unless the construction of said ice and cold storage plant be begun within five years from the date of approval of this amendatory Act and completed within seven years from said date, except when prevented by an act of God, force majeure, martial law, riot, civil commotion, or usurpation of military power or any other cause beyond the grantee’s control.

Section 3. The title of the same Act is hereby amended to read as follows:

"An Act granting Mr. Constante Ibaviosa, his heirs and assigns, a franchise to construct, operate and maintain an ice and cold storage plant in the City of Manila and suburbs and to sell ice and supply cold storage therein."

Section 4. This Act shall take effect upon its approval.
