REPUBLIC ACT No. 4435

An Act Granting the Bolbok Electric and Ice Plant Corporation a Franchise to Construct, Operate and Maintain an Electric Light, Heat and Power System, and an Ice Plant in the Municipality of San Juan, Province of Batangas, and to Distribute and Sell Electric Heat and Power Therein, and also Sell Ice in the Aforesaid Municipality and Neighboring Municipalities

Be it enacted by the Senate and House of Representatives of the Philippine Congress Assembled:

Section 1. Subject to the terms and conditions established in this Act and in Act Numbered Thirty-six hundred and thirty-six, as amended by Commonwealth Act Numbered One hundred and thirty-two, and to the provisions of the Constitution, there is granted to the Bolbok Electric and Ice Plant Corporation, hereinafter called the grantee, for a period of twenty-five years from the approval of this Act, the right, privilege and authority to construct, maintain and operate in the Municipality of San Juan, Province of Batangas, and to distribute and sell electric light, heat and power in the aforementioned municipality, and also to distribute and sell ice in the aforesaid municipality and neighboring municipalities in the Provinces of Batangas and Quezon, and in the Province of Marinduque.

Section 2. In the event that the National Power Corporation shall have established its lines in the area adjacent to or over the territory covered by this legislative franchise, the National Power Corporation may make available its power and heat only after negotiation with and through the Bolbok Electric and Ice Plant Corporation, or with the approval and consent of the grantee.

Section 3. The rates for the sale of electric light, heat, and power and the rates for the sale of ice shall always be subject to the regulations of the Public Service Commission.

Section 4. The grantee shall manufacture and supply ice up to the limit of the capacity of its plant.

Section 5. All the apparatus and appurtenances to be used by the grantee shall be modern, safe and first class in every respect, and the grantee shall, whenever the Public Service Commission has determined that public interest reasonably requires it, change or alter any or its apparatus and appurtenances at grantee’s expense.

Section 6. If the grantee shall not commence the manufacture and distribution of ice within two years from the approval of this Act, unless prevented by an act of God or force majuere, martial law, riot, civil commotion, usurpation by a military power or any other cause beyond the grantee’s control, this franchise shall become null and void.

Section 7. The books, records and accounts of the grantee shall always be open to the inspection of the Auditor General or his authorized representatives, and it shall be the duty of the grantee to submit to the Auditor General quarterly reports in duplicate showing the gross receipts for the quarter past.

Section 8. This Act shall take effect upon its approval.
