REPUBLIC ACT No. 2240
An Act Further Amending Section Five of Republic Act Numbered Six Hundred and Thirteen, as Re-Enacted, Amended and Extended by Republic Acts Numbered Eight Hundred Twenty-Four, Nine Hundred Ninety-Nine and Fourteen Hundred Eighty-Two, Otherwise Known as the Export Control Law, and Inserting a New Section Therein
Be it enacted by the Senate and House of Representatives of the Philippine Congress Assembled:
Section 1. Section five of Republic Act Numbered Six hundred thirteen is hereby amended to read as follows:
Sec. 5. The authority granted in this Act shall terminate on December thirty-one, nineteen hundred sixty-two, unless sooner terminated by concurrent resolution of Congress, except that as to offenses committed, or rights or liabilities incurred prior to such repeal or termination, the provisions of this Act and of the rules and regulations issued thereunder shall be treated as remaining in effect for the purpose of sustaining any suit, action or prosecution with respect to such rights, liabilities or offenses."
Section 2. Between sections five and six of the same Act, the following new section is inserted:
Sec. 5-A. The officials, employees or laborers who may be separated from the service owing to the repeal or termination of the effectivity of Republic Act Numbered Six hundred thirteen shall be entitled to gratuity, which shall be paid in one lump sum, equivalent to one month’s salary for every year of continuous service rendered in the said office and in any other government agencies and instrumentalities on the basis of the last salary received by them but not exceeding twelve months in the aggregate: Provided, That any official, employee or laborer who has rendered less than one year but more than six months of service shall be entitled to gratuity equivalent to one month’s salary: Provided, further, That in case of subsequent reinstatement in the government service or in any government-owned or controlled corporation of such official, employee or laborer who has been paid gratuity, he shall refund to the national government the unexpired portion of the value of the gratuity which he would not have received had it been payable to him in monthly installments."
Section 3. This Act shall take effect upon its approval.
