REPUBLIC ACT No. 1798
An Act to Provide for the Sale of Lands Owned by the Government Located at the Municipality of Montalban, Province of Rizal, to Bona Fide Occupants Thereof, and for Other Purposes

Be it enacted by the Senate and House of Representatives of the Philippine Congress Assembled:
Section 1. Notwithstanding the provisions of the Public Land Law, as amended, the Director of Lands, under the direction of the Secretary of Agriculture and Natural Resources, is hereby authorized and directed to sell without delay and without necessity of public bidding lands owned by the Government located at the Municipality of Montalban, Province of Rizal, the usufruct of which is presently enjoyed by the said municipality, except such portions thereof as may be reserved for roads and other public uses, to the bona fide occupants thereof who have occupied said lands for at least two years immediately preceding the approval of this Act and who are qualified to acquire public lands under existing laws.
Section 2. The selling price of each lot shall be fixed by the Director of Lands upon the recommendation of a committee composed of the Provincial Treasurer and the Provincial Auditor of the Province of Rizal and the Municipal Mayor of the Municipality of Montalban. Each lot for residential purposes shall have an area of not more than three hundred square meters while each cultivable lot fit for gardening shall be limited to the area of actual occupancy. No person shall be allowed to purchase more than one residential and one cultivable lot. Payment of the purchase price may be made by installments payable quarterly for a period of ten years.
Section 3. Except in favor of the Government or any of its branches, subdivisions, units, or institutions, lands acquired under the provisions of this Act shall not be subject to encumbrance or alienation within a period of ten years from the date the patent is issued nor shall they be liable for the satisfaction of any debt contracted before the expiration of said period.
Any contract or agreement made or executed in violation of this section shall be void ab initio.
Section 4. The provisions of the Public Land Law with respect to the sale of public lands which are not inconsistent herewith shall be applicable.
Section 5. This Act shall take effect upon its approval.
