PRESIDENTIAL DECREE No. 1004 September 22, 1976
EXEMPTING THE TOLL FEES COLLECTED FROM THE KENNON AND THE BAGUIO-BONTOC-HALSEMA TOLL ROADS FROM THE OPERATION OF PRESIDENTIAL DECREE NUMBERED SEVEN HUNDRED ELEVEN
WHEREAS, the transfer of the toll fees collected from the operation of the Kennon and the Baguio-Bontoc-Halsema Toll Roads to the General Fund of the National Government, pursuant to Presidential Decree No. 711, has created acute funding problems in the maintenance and improvement of these roads;
WHEREAS, these toll roads are situated in mountainous terrains and are very susceptible to periodic slides and erosions throughout the year, which necessitate immediate maintenance, repair or improvement;
WHEREAS, to assure the immediate repair and continuing maintenance of these roads to keep them open, safe and convenient to the travelling public and in order not to paralyze traffic of commuters and essential commodities, it is necessary to provide ample and available funds at all times.
NOW, THEREFORE, I, FERDINAND E. MARCOS, President of the Philippines, by virtue of the powers in me vested by the Constitution, do hereby order and decree:
Section 1. Toll fees collected from the Kennon and the Baguio-Bontoc-Halsema Roads are hereby exempted from the provisions of Presidential Decree No. 711 and are hereby authorized to be disbursed exclusively for the maintenance, repair and improvement of the said roads in accordance with the program of work prepared by the Highway District Engineer of Benguet and approved by the Highway Regional Director concerned.
Section 2. This Decree shall take effect immediately.
