[ Commonwealth Act No. 70, October 23, 1936 ]
AN ACT REPEALING SECTION SIXTY AND AMENDING SECTIONS SIXTY-NINE AND SEVENTY-SIX OF COMMONWEALTH ACT NUMBERED ONE, KNOWN AS THE NATIONAL DEFENSE ACT.
Be it enacted by the National Assembly of the Philippines:
Section 1. Section sixty of Commonwealth Act Numbered One, known as the National Defense Act, is hereby repealed.
Section 2. Section sixty-nine of Commonwealth Act Numbered One, known as the National Defense Act, is hereby amended to read as follows:
"Section 69. Where dependency was the cause for deferment and that condition continues after the termination of the period of deferment, the young man shall be liable to trainee instruction, and shall enter upon such instruction. During the period of his absence undergoing instruction, an allowance for the partial support of his dependent or dependents, who have no other means of support, shall be made by the Philippine Government. The corresponding acceptance board shall determine the dependent or dependents entitled to this allowance, which shall be fixed by Executive Order."
Section 3. Section seventy-six of Commonwealth Act Numbered One, known as the National Defense Act, is hereby amended by inserting a new section after it, which shall be known as section seventy-six-A, and shall read as follows:
"Section 76-A. Any person failing to register for military service herein provided, or who shall fail to report to the corresponding acceptance board or to a designated training station after having been duly notified to do so shall, upon conviction, be sentenced to serve not more than one year in prison or to pay a fine of not to exceed two thousand pesos, or both, at the discretion of the court.ℒαwρhi৷ Conviction for this offense shall not exempt the person convicted from the military service herein required."
Section 4. This Act shall take effect upon its approval.
