AN ACT AMENDING ACT NUMBERED THIRTEEN HUNDRED AND TWENTY-ONE, ENTITLED "AN ACT ABOLISHING THE OFFICE OF FISCAL FOR THE PROVINCE OF ORIENTAL NEGROS AND PROVIDING THAT THE DUTIES OF FISCAL FOR THAT PROVINCE SHALL BE PERFORMED BY THE FISCAL OF THE PROVINCE OF CEBU."

By authority of the United States, be it enacted by the Philippine Commission, that:

Section 1. Section two of Act Numbered Thirteen hundred and twenty-one, entitled "An Act abolishing the office of fiscal for the Province of Oriental Negros and providing that the duties of the fiscal for that province shall be performed by the fiscal of the .Province of Cebu/' is hereby amended to read as follows:

"Section 2. The duties imposed by law upon the fiscal for the .Province of Oriental Negros shall hereafter be performed by the fiscal of the Province of Cebu. In view of the additional duties hereby imposed upon the fiscal of the Province of Cebu the salary of the fiscal of the two provinces shall be two thousand nine hundred dollars, United States currency, per annum, of which one thousand- eight hundred dollars shall be paid by the Province of Cebu and one thousand one hundred dollars by the Province of Oriental Negros, but the fiscal shall appoint and shall pay for, out of his salary, a deputy fiscal for the Province of Oriental Negros who shall not necessarily he subject to the provisions of the Civil Service Act, and who shall assist the fiscal of Cebu in the performance of his official duties in the Province of Oriental Negros and also in the Province of Cebu when his services are not required for the Province of Oriental Negros, and who shall reside at Dumaguete, in the Province of Oriental Negros, or at Cebu, in the Province of Cebu, at the discretion of the fiscal of Cebu. The fiscal of John is hereby authorized, when necessary, temporarily to detail from the office of fiscal of the Province of Cebu one or more of the subordinate employees of said office for duty in the Province of Oriental Negros1aшphi1. The necessary traveling expenses of the fiscal and subordinate employees of his office in going to Dumaguete from Cebu and in returning to Cebu, and while traveling in the Province of Oriental Negros in the performance of official duties pertaining to said province, shall he paid by the Province of Oriental Negros. The necessary expenses of subsistence of the fiscal, the deputy fiscal for Oriental Negros should his residence be fixed at Cebu, and other employees detailed for temporary duty in Oriental Negros, while staying at Dumaguete, shall be considered subsistence expenses payable by the Province of Oriental Negros: Provided, That the provisions of Act Numbered Thirteen hundred and thirty-four shall be applicable in all cases. Should the deputy fiscal reside at Dumaguete the same rule shall apply upon his temporary detail to Cebu, the expenses to be paid by the Province of Cebu, which province shall in any event pay his traveling expenses between the provinces, irrespective of his place of residence. Upon the recommendation of the provincial board of Oriental Negros and the approval of the Insular Treasurer said fiscal is hereby authorized to appoint a clerk in the office of fiscal at Dumaguete whose salary shall be paid from the funds of said Province of Oriental Negros."

Section 2. The public good requiring the speedy enactment of this bill, the passage of the same is hereby expedited in accordance with section two of "An Act prescribing the order of procedure by the Commission in the enactment of laws,"' passed September twenty-sixth, nineteen hundred.

Section 3. This Act shall take effect on its passage.
