AMENDING PROCLAMATION NO. 458 DATED SEPTEMBER 25, 1965, RESERVING A PARCEL OF RECLAIMED LAND SITUATED IN PANACAN, DAVAO CITY, ISLAND OF MINDANAO AS EXPANSION SITE OF THE PHILIPPINE NAVY RESERVATION

Upon the recommendation of the Secretary of the Department of Environment and Natural Resources, and by virtue of the powers vested in me by law, I, GLORIA MACAPAGAL-ARROYO, President of the Philippines do hereby amend Proclamation No. 458 dated September 25, 1965 by expanding the area covered by the reservation to include the reclaimed land with an area of One Hundred Seven Thousand, Two Hundred Eighty Four (107,284) square meters, situated in Panacan, Davao City, Island of Mindanao, subject to private rights, if any there be, which parcel of land is more particularly described as follows:

A parcel of land (plan NR-11-000012) situated in the Barrio of Panacan, City of Davao, Island of Mindanao.

Bounded on the SW., along lines 1-2-3-4 by Lot 575-A-1, Psd-16468; along lines 4-5-6 by Lot 575-B-1, Psd-16468; along lines 6-7-8 by Lot 575-C-1, Psd-16468, along lines 8-9-10-11-12-13 by Lot 573-D-1, Psd-16468, on the W., along line 13-14 by Panacan Creek; on the NW., N., NE., E., and SE., along lines 14-15-16-17-18-19-20-21-22-23-24-1 by Davao Gulf.

All corners not otherwise described and marked “X” as concrete sea wall and the rest by Old P.S. Cyl., conc. Mons 15 x 60, bearing true.

This lot was surveyed in accordance with and existing regulations promulgated thereunder by Timoteo D. Cajipe, Geodetic Engineer on January 9, 1986 and was approved on February 17, 1989.1aшphi1

The tracts of land herein reserved shall be inalienable and shall not be subject to occupation, entry, sale, lease, or other disposition until again declared as alienable by proclamation of the President.

This reservation is further subject to the following conditions:

1. The Philippine Reclamation Authority shall be free and harmless from any liabilities or suits filed by third parties arising from the acts done or omissions made in the process of reclamation;

2. That the width of the road abutting the lot applied for shall have the minimum right-of-way reservation to comply with the mandatory provisions of E.O. No. 113, S. 1955;

3. That all waterways, passing through or adjoining the said lot be considered parts of Public Domain and shall be subject of the mandatory provisions of P.D. 296 and P.D. 1067;

4. That the reservation shall not encroach on the existing area and structures of the 11th Regional Equipment Services Office, Department of Public Works and Highways, Panacan, Davao City;

5. That no port or port related structures shall be constructed at the subject area without prior clearance/approval of the Philippine Ports Authority.
