MALACAÑAN PALACE MANILA BY THE PRESIDENT OF THE PHILIPPINES [ Proclamation No. 1033-A, October 16, 2006 ] AMENDING PROCLAMATION NO. 1033, DATED 13 MARCH 2006, TRANSFERRING THE ADMINISTRATION OF THE OFF-BASE HOUSING PROJECT TO THE ARMED FORCES OF THE PHILIPPINES REPRESENTED BY THE PHILIPPINE ARMY AND MODIFYING THE MODE OF DISPOSITION PURSUANT TO REPUBLIC ACT 730, IN RELATION TO PERTINENT PROVISIONS OF COMMONWEALTH ACT 141 OR THE PUBLIC LAND ACT, AS AMENDED WHEREAS, one of the Administrations priority concerns is the provision of houses to deserving homeless Filipinos and pursuant thereto, the Administration has launched a program that will ensure that lands proclaimed as housing sites are disposed of to the intended beneficiaries in the most expeditious, equitable and participatory manner; WHEREAS, Proclamation No. 1033 was issued on 13 March 2006 excluding from the operation of Proclamation No. 237 (s. 1955) which established Fort Magsaysay Military Reservation, a portion of land with an area of Two Million Square Meters (2,000,000 sq. m.) situated in the Municipalities of Gen. Tinio, Sta. Rosa, Laur and Gabaldon, and the City of Palayan, Province of Nueva Ecija, and declaring the same as site for the off-base housing of the Armed Forces of the Philippines (AFP), represented by the Philippine Army (PA), to be disposed and administered by the National Housing Authority (NHA) to qualified beneficiaries; WHEREAS, there is an urgent need for the AFP, represented by the PA to oversee and administer the immediate execution of the herein off-base housing project pursuant to its mandate; WHEREAS, the Department of Environment and Natural Resources (DENR) is the administrator of lands of the public domain, and that the disposition of the proclaimed site should be disposed of to qualified beneficiaries pursuant to Republic Act 730, in relation to the provisions of Commonwealth Act 141 or the Public Land Act, as amended. WHEREAS, the tie lines of the proclaimed site as stated in Proclamation No. 1033 should read as follows: Beginning at point marked “1” on plan, being S 67 deg 46' E, 2368.55 meters from BLLM No. 1, PLS 378 (NG-130). NOW, THEREFORE, I GLORIA MACAPAGAL-ARROYO, President of the Republic of the Philippines, by virtue of the powers vested in me by law, do hereby amend Proclamation No. 1033 dated 13 March 2006, and hereby declare that: 1. The administration of the Off-Base Housing Project shall be transferred from the National Housing Authority (NHA) to the Armed Forces of the Philippines, as represented by the Philippine Army. 2. As the designated administrator of the proclaimed area, the PA, AFP is hereby directed and authorized to directly oversee and fast track through appropriate project schemes and contractual arrangements, subject to existing laws, rules and regulations, the implementation and development of the Off-Base Housing Project. 3. The PA, AFP shall formulate a budget to implement this Proclamation taking into account the funding requirement for various activities to be undertaken in connection hereof. The AFP is authorized to provide the corresponding funds for the site developmental cost and other logistical requirements of this project. 4. The DENR shall be the lead agency responsible for the disposition of the Off-Base Housing Site, pursuant to Republic Act 730, in relation to the pertinent provisions of Commonwealth Act 141 or the Public Land Act, as amended, subject to private rights, if any there be, and to final survey. Further, the DENR shall prepare a Special Patent for the 200-hectares proclaimed site in favor of the PA, AFP. 5. The tie line as provided for in Proclamation No. 1033 is hereby corrected and should read as follows: Beginning at point marked “1” on plan, being S 67 deg 46' E, 2368.55 meters from BLLM No. 1, PLS 378 (NG-130). 6. An Inter-Agency Committee (IAC) shall be created to facilitate the conduct of post-proclamation activities necessary to dispose of the proclaimed site to the qualified beneficiaries.1aшphi1 IN WITNESS HEREOF, I have hereunto set my hand and caused the seal of the Republic of the Philippines to be affixed.
