MALACAÑAN PALACE MANILA BY THE PRESIDENT OF THE PHILIPPINES [ Proclamation No. 1023, March 3, 2006 ] AMENDING PROCLAMATION NO. 1240, EXEMPTING CERTAIN PORTIONS OF PUBLIC LAND IN ALABANG, CITY OF MUNTINLUPA, FROM SALE OR OTHER DISPOSITION UNDER COMMONWEALTH ACT 1120 AND RESERVING THE SAME AS SITE FOR GOVERNMENT PROJECTS UNDER THE CONTROL AND ADMINISTRATION OF THE CITY GOVERNMENT OF MUNTINLUPA. WHEREAS, the National Government owns a 244-hectare property located in Alabang, Muntinlupa City, covered by Transfer Certificate of Title No. 185552 issued by the Registry of Deeds for Makati City and identified as Lot 39 of the Muntinlupa Estates under the Provisions of Act No. 120 as amended; WHEREAS, Proclamation No. 1240 was enacted allocating an aggregate area of 9.6103 hectares of the property above stated in favor of the City Government of Muntinlupa as its equitable share in the proceeds of the utilization and development of the national wealth, pursuant to Section 7, Article X of the 1987 Constitution and Section 289 of R.A. 7160 or the Local Government Code of 1991; WHEREAS, the use of the property described and delineated in Proclamation No. 1240 was reserved for civic center, public market and city public high school under the control and administration of the City Government of Muntinlupa; WHEREAS, there is a need to reclassify the use for which the lands were devoted in order to give the City Government of Muntinlupa a better initiative and free hand to develop the property pursuant to the declared policy of the state that the territorial and political subdivisions shall enjoy genuine and meaningful local autonomy to enable them to obtain their fullest development as communities and make them more effective partners in the attainment of national goals, as enunciated in Section 2 of R.A. 7160; NOW, THEREFORE, I, GLORIA MACAPAGAL-ARROYO, President of the Republic of the Philippines, by virtue of the authority vested in me by law, hereby reclassify the lands described and delineated in Proclamation No. 1240 dated June 23, 1998 as site for civic center, public market, public high school, city government center and such other government projects under the control and administration of the Muntinlupa City Government.1aшphi1 Title to and ownership of the area covered by this proclamation shall be conveyed to the City of Muntinlupa. Provided that the lots covered shall not be alienated, transferred, or conveyed to any persons or entities, neither shall the same be encumbered nor be the subject of any transaction, contract or agreement which may lead to the change or diminution of ownership of the reserved properties.
