[ PROCLAMATION NO. 817, March 22, 2005 ]

AMENDING PROCLAMATION NO. 2017 DATED 19 SEPTEMBER 1980, BY EXCLUDING A PARCEL OF LAND OF THE PUBLIC DOMAIN FROM THE CAVITE ECONOMIC ZONE SITUATED IN THE MUNICIPALITY OF ROSARIO, PROVINCE OF CAVITE, AND DECLARING THE SAME AS ALIENABLE AND DISPOSABLE TO SERVE AS PERMANENT RELOCATION SITE OF DISPLACED FARMERS DUE TO THE PROCLAMATION AND DEVELOPMENT OF THE ZONE.

Pursuant to the powers vested in me under Republic Act No. 7916, otherwise known as the Special Economic Zone Act of 1995, as amended, and upon recommendation of the Board of Directors of the Philippine Economic Zone Authority, I, GLORIA MACAPAGAL-ARROYO, President of the Philippines, do hereby amend Proclamation No. 2017, dated 19 September 1980, by excluding an area from the designated Cavite Economic Zone, subject to the provisions of Republic Act No. 7916, as amended, its Implementing Rules and Regulations, and Resolutions Nos. 91-075 and 03-105 dated 15 April 1991 and 22 April 2003, respectively, of the Board of Directors of the Philippine Economic Zone Authority, an area located at Barangay Tejero, Municipality of Rosario, Province of Cavite, consisting of NINE THOUSAND ONE HUNDRED SIXTEEN (9,116) SQUARE METERS, as defined by the following technical description:

A parcel of Land (lot 1412-B of the subdivision plan Psd-04-169927 being a portion of Lot 1412, San Francisco de Malabon Estate (Rs-04217-001810); (LRC Rec. No, 5694); situated in the Barangay of Tejero, Municipality of Rosario, Province of Cavite, Island of Luzon.

Bounded on the S. along line 1-2 by Lot 570 (Property of Cavite College of Arts & Trades); on the SW., along line 2-3 by Lot 1410; both of San Francisco de Malabon Estate; and on the N., W., NW. & E., along lines 3-4-5-6-1 by Lot 1412-A of the subdivision plan.

Beginning at a point marked "1" on plan, being S. 81 deg. 38’ E., 400.39 m. from Mon. 115, San Francisco de Malabon Estate;

Thence S. 77 deg. 18’ W 104.19 m. to point 2;

Thence N. 10 deg. 41’ W 49.23 m. to point 3;

Thence N 85 deg. 03’ E 48.96 m. to point 4;

Thence N 1 deg. 21’ W 69.01 m. to point 5;

Thence N 73 deg. 20’ E 63.54 m. to point 6;

Thence S 1 deg. 21’ E 116.94 m. to point of;

Beginning, containing an area of NINE THOUSAND ONE HUNDRED SIXTEEN (9,116) SQUARE METERS. All points referred to are indicated on the plan and are marked on the ground as follows: corner 2 by Old P.S. and rest by P.S. cyl. conc. mons 15 x 60 cm.; bearings true; date of original survey: During 1905-1908; and that of the subdivision survey: June 3, 2004 and was approved on September 13, 2004.

Further, upon recommendation of the Secretary of Environment and Natural Resources, I hereby declare the above-described land as alienable and disposable to serve as permanent relocation site of displaced farmers due to the proclamation and development of the zone.

All lands disposed of under this proclamation shall not be subject to alienation for a period of ten (10) years from the issuance of the title, nor shall become liable for the satisfaction of any debt contracted prior to the expiration of the said period; but the same may be mortgaged to the Government Service Insurance System or to PAG-IBIG, whichever is applicable.

The DENR and PEZA shall prepare the Implementing Rules and Regulations of this Proclamation.ℒαwρhi৷
