EXCLUDING FROM THE OPERATION OF PROCLAMATION NO. 423 DATED JULY 12, 1957 WHICH ESTABLISHED THE MILITARY RESERVATION KNOWN AS FORT WILLIAM MCKINLEY (NOW FORT ANDRES BONIFACIO) SITUATED IN THE MUNICIPALITIES OF PASIG, TAGUIG, PATEROS, PARAÑAQUE AND PASAY CITY, METROPOLITAN MANILA, AS AMENDED BY PROCLAMATIONS NOS. 2475 AND 518 DATED JANUARY 7, 1986 AND JANUARY 31, 1990, RESPECTIVELY, CERTAIN PARCELS OF LAND EMBRACED THEREIN SITUATED IN THE MUNICIPALITY OF TAGUIG, METROPOLITAN MANILA, AND DECLARING THE SAME OPEN FOR DISPOSITION UNDER THE PROVISIONS OF REPUBLIC ACT NO. 274 IN RELATION TO THE PROVISIONS OF THE PUBLIC LAND ACT (C. A. 141), AS AMENDED

Upon recommendation of the Secretary of Environment and Natural Resources, and by virtue of the powers vested in me by law, I, CORAZON C. AQUINO, President of the Philippines, do hereby exclude from the operation of Proclamation No. 423 dated July 12, 1957, which established the Military Reservation known as Fort William McKinley (now Fort Andres Bonifacio) situated in the Municipalities of Pasig, Taguig, Pateros and Parañaque, Province of Rizal (now Metropolitan Manila), certain parcels of land embraced therein situated in the Municipality of Taguig, Metropolitan Manila, and declare the same open for disposition in accordance with Republic Act No. 274 in relation to the provisions of the Public Land Act (C.A. 141), as amended, which parcels are particularly described as follows, to wit:

Bounded on the North along line 1-2 by Fort Bonifacio Military Reservation (Port. of Lot 3, Psu-2031); on the East along lines 2-3-4 by MCadm-590-D, Taguig Cadastral Mapping (Barangay Ususan); on the South along line 4-5 by Fort Bonifacio Military Reservation (Port. of Lot 3, 2031); and on the West along line 5-1 by Lot 3, Swo-13-000682 (Existing Meralco Transmission Line (R.O.W. 30.00 m. wide). Beginning at a point marked “1” on plan, being N. 87° 01" W., 1601.03 m. from BLLM #1, MCadm-590-D, Taguig Cad. Mapping. Thence . . . . .

Any provisions of the law to the contrary not withstanding, disposition of the lots under this proclamation shall be by direct sale in relation to the provisions of Republic Act No. 274 and the Public Land Act (C.A. 141), as amended, subject to private rights, if there be any. Such disposition of the subdivision lots by the Regional Executive Director of the National Capital Region of the Department of Environment and Natural Resources shall be in accordance with the following conditions and sets of priorities: (1) Resident Homeowner families that are directly affected by the construction of C-5 and R-4; (2) Resident Homeowner families that are directly affected by other infrastructure projects within Proclamation No. 518; (3) Resident Homeowners families under the coverage of Proclamation No. 518 whose resultant lots is less than fifty (50) square meters; (4) Boarders or renters under the coverage of Proclamation No. 518 as of January 7, 1986, or prior thereto.

The minimum area that shall be allowed for disposition to any bonafide beneficiary and qualified applicants should be sixty (60) square meters and the maximum area shall in no instance be more than One Hundred Twenty (120) square meters. All residential lots generated by the subdivision survey shall be strictly reserved and disposed of primarily to those who might be dislocated by virtue of the proposed construction of the Circumferential Road 5 (C-5) and Radial Road 4 (R-4), Makati Segment as enumerated in the set of priorities and the remaining area to any on-going infrastructure projects like road widening and road alignment, site development etc. within the Ministry Reservation in the Municipalities of Makati and Taguig. In the event that there are more dislocated occupants or residents compared to the number of available vacant lots generated, disposition of the said vacant lots shall be raffled among all those dislocated residents, provided, however, that all shall have qualified in accordance with the provisions of the basic laws that govern the disposition thereof.

In addition, an area of four (4) hectares within Lot 1, Swo-13-000682 and as identified by the Bliss Development Corp. shall likewise be segregated for allocation to resident families that are affected by the Bliss Development Corporation Housing Program. Such area being segregated shall be administered and disposed of by the Bliss Development Corporation in coordination with the Department of Environment and Natural Resources, National Capital Region.
