CONVERTING A PORTION OF THE PRISON SITE OF THE NEW BILIBID PRISON TO PATRIMONIAL PROPERTY OF THE GOVERNMENT AND DECLARING THE SAME OPEN TO DISPOSITION AS THE SITE OF THE DEPARTMENT OF JUSTICE HOUSING PROJECT IN ACCORDANCE WITH THE PROVISIONS OF ACT NUMBERED THREE THOUSAND AND THIRTY-EIGHT.

WHEREAS, the Government recognizes that shelter is a basic requirement for which low income families, particularly public servants, require assistance;

WHEREAS, the rapid expansion and urbanization of the Metropolitan Manila area has focused on the need to establish new housing sites within a 30-kilometer radius from the center of the metropolis;

WHEREAS, a tract of land with an area of 5,310,872 square meters located at Muntinlupa, Metropolitan Manila, was acquired by the Government in 1936 as the site of the New Bilibid Prison;

WHEREAS, the entire area of the said land has not been utilized as a prison site;

WHEREAS, the segregation of 1,000,000 square meters, more or less, of land from such prison site for use as a low-cost housing project for the personnel of the Department of Justice and its bureaus, offices and agencies will not in any manner adversely affect the operational requirements of the New Bilibid Prison;

NOW, THEREFORE, I, CORAZON C. AQUINO, President of the Philippines, by virtue of the powers vested in me by law, do hereby declare (1) the conversion to patrimonial property of a portion of the present site of the New Bilibid Prison covered by Transfer Certificate of Title No. 30226 of the Register of Deeds of Rizal, said portion not being utilized for prison purposes, consisting of one million (1,000,000) square meters, more or less, and more particularly described hereunder; and (2) its disposition as the site of the Department of Justice housing project in accordance with the provisions of Act No. 3038 entitled “An Act Authorizing the Secretary of Agriculture and Natural Resources To Sell or Lease Land of the Private Domain of the Government of the Philippine Islands”:

A Parcel of Land (being a portion of the consolidation of Lots Nos. 382, 383, 384, 385, 386 and 1202, Muntinlupa Poblacion, Municipality of Muntinlupa, Metro Manila, Island of Luzon. Bounded on the North, along line 1-2 by lot 387, Muntinlupa Estate Subdivision (Ayala Alabang Subdivision) and (LRC) Psd-150699 (South Green Heights Subdivision), along line 2-3-4-5-6-7-8-9-10-11-12-13-14-15-16-17-18-19-20-21-22-23, by Muntinlupa Municipal High School Site and along line 23-24, by (LRC) Psd-150699 (South Green Heights Subdivision); on the East, SE, South and SW, along line 24-25-26-27-28-29-30-31-32-33-34-35-36-37-38, by the remaining portion of the consolidated lots, and on the West, along line 38-1, by the Municipality of Las Piñas.ℒαwρhi৷

The portion or portions of the area herein declared open to disposition as are presently used or earmarked for public or quasi-public purposes shall be excluded from such disposition, except in favor of the Government or any of its branches or agencies. All lands disposed of under this Proclamation shall not be subject to alienation for a term of ten (10) years from the issuance of the title, in case of sale, or execution of the contract, in case of lease, nor shall they become liable for the satisfaction of any debt contracted prior to the expiration of the said period; but that the same, together with the improvements thereon, may be mortgaged to the Government Service Insurance System (GSIS).

The housing project referred to herein shall be administered by the Department of Justice and, for this purpose, the Department of Environment and Natural Resources shall provide assistance in the disposition of home lots to qualified officials and employees of the Department of Justice and its bureaus, offices and agencies.
