EXCLUDING FROM THE OPERATION OF PROCLAMATION NO. 423 DATED JULY 12, 1957 WHICH ESTABLISHED THE MILITARY RESERVATION KNOWN AS “FORT WILLIAM MCKINLEY” (NOW FORT ANDRES BONIFACIO) SITUATED IN THE MUNICIPALITIES OF PASIG, TAGUIG, PATEROS AND PARAÑAQUE, PROVINCE OF RIZAL AND PASAY CITY (NOW METROPOLITAN MANILA) AS AMENDED BY PROCLAMATION NO. 2475 DATED JANUARY 7, 1986, CERTAIN PORTIONS OF LAND EMBRACED THEREIN KNOWN AS BARANGAYS CEMBO, SOUTH CEMBO, WEST REMBO, EAST REMBO, COMEMBO, PEMBO AND PITOGO, SITUATED IN THE MUNICIPALITY OF MAKATI, METROPOLITAN MANILA AND DECLARING THE SAME OPEN FOR DISPOSITION UNDER THE PROVISIONS OF REPUBLIC ACT NO. 274, AND REPUBLIC ACT NO. 730 IN RELATION TO THE PROVISIONS OF THE PUBLIC LAND ACT, AS AMENDED

Upon recommendation of the Secretary of Environment and Natural Resources, and by virtue of the powers vested in me by law, I, CORAZON C. AQUINO, President of the Philippines, do hereby exclude from the operation of Proclamation No. 423 dated July 12, 1957 which established the Military Reservation known as Fort William McKinley (now Fort Andres Bonifacio) situated in the Municipalities of Pasig, Taguig, Pateros and Parañaque, Province of Rizal and Pasay City (now Metropolitan Manila) as amended by Proclamation No. 2475 dated January 7, 1986 certain portions of the land embraced therein known and identified as the regular Barangays of Cembo, South Cembo, West Rembo, East Rembo, Comembo, Pembo and Pitogo, situated in the Municipality of Makati, Metropolitan Manila and declared the same open for disposition in accordance with Republic Act No. 274, and Republic Act No. 730 in relation to the provisions of the Public Land Act, as amended, which portion is more particularly described as follows:

Any provisions of the law to the contrary notwithstanding, disposition of the lots under this proclamation covering the portion of the reservation shall be exempted from the usual publication and open public bidding requirements under Act 3038 and shall be disposed of in accordance with the provisions of Republic Act No. 730 as implemented under Land Administrative Order No. 19 dated November 4, 1954 in relation to the provisions of Republic Act 274 and the Public Land Act, as amended, subject to private rights if there be any. Such disposition of the subdivision lots by the Regional Executive Director of the National Capital Region of the Department of Environment and Natural Resources shall be limited to bona fide occupants who are residing on the proclaimed area on or before January 7, 1986.

The minimum area that shall be allowed for disposition to any bona fide occupants/residents should be 50 square meters and the maximum area shall in no instance be more than 300 square meters. All residential vacant lots generated during the subdivision survey shall be strictly reserved and disposed of to those occupants or residents of the proclaimed area who might be dislocated by virtue of any proposed or on-going infrastructure projects like road widening and road alignment, site development, etc., and those occupants or residents who are termed or classified as borders or tenants. In the event that there are more dislocated occupants or resident compared to the number of available vacant lots generated, disposition of the said vacant lots shall be raffled among all those dislocated occupants or residents provided however that all shall have qualified in accordance with the provisions of the basic laws that govern the disposition hereof.

This amends Proclamation No. 2475 dated January 7, 1986, which amended Proclamation No. 423, series of 1957.
