PROCLAMATION NO. 1959
PROCLAIMING THE RATIFICATION BY THE FILIPINO PEOPLE OF THE AMENDMENT OF SECTION 7, ARTICLE X OF THE CONSTITUTION.
WHEREAS, the Interim Batasang Pambansa passed Resolution No. 21 dated December 18, 1979, proposing the amendment of Section 7, Article X of the Constitution which reads as follows:
"SEC. 7. The Members of the Supreme Court and judges of inferior courts shall hold office during good behavior until they reach the age of SEVENTY years or become incapacitated to discharge the duties of their office. The Supreme Court shall have the power to discipline judges of inferior courts and, by a vote of at least eight Members, order their dismissal."
WHEREAS, the aforesaid resolution provides that the proposed amendment shall take effect on the date the incumbent President/Prime Minister of the Philippines shall proclaim that it has been ratified by a majority of the votes cast in the plebiscite held, together with the election for local officials, on January 30, 1980;
WHEREAS, in said plebiscite twelve million two hundred one thousand three hundred fifty seven (12,201,357) voted in favor of the proposed amendment as against a negative vote of two million seven hundred ninety-six thousand two hundred thirty-nine (2,796,239), according to the certificate of Canvass of the votes cast issued by the Commission on Elections on March 15, 1980; and
WHEREAS, the affirmative votes represent a majority of the votes cast in said plebiscite;
NOW, THEREFORE, I, FERDINAND E. MARCOS, President of the Philippines, by virtue of the powers vested in me by law, do hereby proclaim that the above-quoted amendment has been duly ratified by a majority of the votes cast in the plebiscite held, together with the election for local officials, on January 30, 1980, and that said amendment is hereby declared to take effect immediately.ℒαwρhi৷
