Proclamation No. 604

EXCLUDING FROM THE OPERATION OF THE RESOLUTIONS OF THE PHILIPPINE COMMISSION DATED JANUARY 25, 1907 AND AUGUST 30, 1916 AND OPENING TO DISPOSITION UNDER THE PROVISIONS OF COMMONWEALTH ACT NUMBERED ONE HUNDRED AND THIRTY-SEVEN A PARCEL OF LAND SITUATED WITHIN THE BAGUIO TOWNSITE RESERVATION.

Whereas a petition has been filed for the release of certain mining claims from the Baguio Townsite Reservation, City of Baguio, established under Resolutions of the Philippine Commission dated January 25, 1907, and August 30, 1916;

Whereas, according to the report of the Director of Mines, concurred in by the Secretary of Agriculture and Commerce, the land embraced in said mining claims now included within the Baguio Townsite Reservation appears to be mineralized; and

Whereas, under the provisions of section fourteen of Commonwealth Act Numbered One hundred and thirty-seven, otherwise known as the Mining Act, lands within reservations for purposes other than mining, which, after such reservation is made, arc found to be more valuable for their mineral contents than for the purpose for which the reservation was made, may be withdrawn from such reservations by the President of the Philippines only with the concurrence of the National Assembly;

Now, therefore, I, Manuel L. Quezon, President of the Philippines, by virtue of the powers vested in me by law, do hereby exclude from the operation of the Resolutions of the Philippine Commission dated January 25, 1907, and August 30, 1916, the following described parcel of land situated in the City of Baguio, island of Luzon, to wit:

Beginning at a point ‘1’ which is identical to corner 3, the southeastern most corner of Baguio Townsite Reservation; thence N. 79° 14′ W., 2,400.00 meters to point ‘2’, thence N. 10° 46’E., 600.00 meters to point ‘3’, thence S. 79° 14’E., 2.399.30 meters to point ‘4’, thence S. 10° 42′ W., 600.00 meters to point ‘1’, which is the point of beginning.

"Containing an area of one hundred forty-three and ninety-eight hundredth (143.98) hectares, more or less.

"All points referred to arc marked on the ground. Corner ‘1’ is a concrete monument 15 centimeters in diameter by 60 centimeters long. All the rest are concrete monuments 30 x 30 x 120 centimeters in size.

"Bounded on the north by Baguio Townsite Reservation; on the east by Mercedes Fraction and Padilla Fraction mineral claims of Southern Cross Mining Company; on the south by Nugget Fraction and Dolores Fraction mineral claims of Cal Horr Mines, Remy Fraction, Helen Fraction, Nena Fraction, Kappa Fraction, and Theta Fraction mineral claims of Benguet Goldfields. Anak Fraction, Marakit Fraction, and Golden Gate Fraction mineral claims of the Demonstration Gold Mines, Ltd.; and Oxford Fraction and Sierra Fraction mineral claims of Crown Mines, Inc.; and on the west by Baguio Townsite Reservation.

"Bearings true."

This proclamation shall not take effect until it is concurred in by a resolution of the National Assembly duly adopted for the purpose.
