[ MEMORANDUM ORDER NO. 31, August 27, 2024 ]
CONCURRENCE OF THE PRESIDENT IN THE DEPUTATION OF LAW ENFORCEMENT AGENCIES AND INSTRUMENTALITIES OF THE GOVERNMENT IN CONNECTION WITH THE 31 AUGUST 2024 PLEBISCITE TO RATIFY THE DIVISION OF BARANGAY BAGONG SILANG IN THE CITY OF CALOOCAN INTO SIX (6) SEPARATE AND INDEPENDENT BARANGAYS
WHEREAS, Section 1 of Republic Act No. 11993 or the "Act Dividing Barangay 176, also known as Barangay Bagong Silang in the City of Caloocan" divides Barangay Bagong Silang into six (6) separate and independent Barangays to be known as Barangays 176-A, 176-B, 176-C, 176-D, 176-E, and 176-F;
WHEREAS, the Commission of Elections (COMELEC) En Banc, through Resolution No. 11017 (s. 2024), resolved to request Presidential concurrence in the deputation of law enforcement agencies and instrumentalities of the government for the 31 August 2024 plebiscite to ratify the division of Barangay Bagong Silang;
WHEREAS, Section 2(4), Article IX-C of the Constitution empowers the COMELEC to deputize law enforcement agencies and instrumentalities of the government to ensure fees, orderly, honest, peaceful, and credible elections, subject to the concurrence of the President;
WHEREAS, Section 18, Article VII of the Constitution provides that the President shall be the Commander-in-Chief of all armed forces of the Philippines; and
WHEREAS, Section 17, Article VII of the Constitution vests in the President the power of control over all executive departments, bureaus, and offices;
NOW, THEREFORE, I, FERDINAND R. MARCOS, JR., President of the Philippines, by virtue of the powers vested in me by the Constitution and exiting laws, and as requested in COMELEC Resolution No. 11017, hereby CONCUR with the COMELEC's deputation of the Armed Forces of the Philippines, Philippine National Police, and other law enforcement agencies and instrumentalities of the government in connection with the 31 August 2024 plebiscite to ratify the division of Barangay Bagong Silang in the City of Caloocan into six (6) separate and independent Barangays to be known as Barangay 176-A, 176-B, 176-C, 176-D, 176-E, and 176-F.
The foregoing law enforcement agencies and other concerned agencies are hereby directed to coordinate and cooperate with the COMELEC in the performance of their duties and functions, subject to existing laws, rules and regulations.ℒαwρhi৷
