[ Memorandum Order No. 85, February 3, 1993 ]

DIRECTING THE DEPARTMENT OF TOURISM AND THE PHILIPPINE TOURISM AUTHORITY TO ALLOCATE A PORTION OF THE NET PROFITS OF THE DUTY FREE PHILIPPINES FOR THE IMPROVEMENT OF THE NINOY AQUINO INTERNATIONAL AIRPORT (NAIA) AND DECLARING THE IMPROVEMENT OF NAIA A PRIORITY TOURISM PROJECT

WHEREAS, Executive Order No. 46, issued September 4, 1986, Section 3 provides that “All net profits from the merchandising operations conducted pursuant hereto shall accrue to the Ministry of Tourism which shall allocate the same in accordance with existing policies and regulations”;

WHEREAS, Tourism Administrative Order No. 89-05, issued March 6, 1989, Implementing Rules and Regulations on the Allocation of Net Profits of the Duty and Tax Free Merchandising System in the Philippines Pursuant to E.O. No. 46, s. 1986, Art. 1, Section 1 thereof provides: “The Secretary of Tourism shall determine what reasonable percentage or portion of the net earnings shall accrue to the Department of Tourism to fund financial assistance and contributions as well as grants and subsidies, etc. to government and private sector programs/projects that are public service or tourism oriented”;

WHEREAS, the Permanent Committee, created pursuant to Section 51, P.D. No. 1177, in its Resolution of June 14, 1990, provided that “the Department of Tourism shall allocate and disburse funds from said trust account solely for purposes intended to enhance the tourism development programs and projects in the country;

WHEREAS, there is a need to improve the facilities and infrastructures of the Ninoy Aquino International Airport (NAIA) in view of its immediate impact and importance to the tourism industry”;

NOW, THEREFORE, I, FIDEL V. RAMOS, President of the Philippines, by virtue of the power vested in me by law, do hereby order:

Section 1. The improvement of the Ninoy Aquino International Airport (NAIA) is hereby declared a Priority Tourism Project.ℒαwρhi৷

Section 2. The Department of Tourism and the Philippine Tourism Authority are hereby directed to grant the necessary allocations for the improvement and maintenance of the facilities and infrastructures of the NAIA, through financial assistance and tourism projects.

Section 3. The said financial assistance and tourism projects shall be funded from the net profits of the merchandising operations of the Duty Free Philippines, pursuant to Executive Order No. 46, issued September 4, 1986, and all rules issued pursuant thereto.

Section 4. The Secretary of the Department of Tourism, the General Manager of the Philippine Tourism Authority, and the General Manager of the Ninoy Aquino International Airport shall coordinate in the implementation of this Order.

Section 5. This Memorandum Order shall take effect immediately.
