[ Memorandum Order No. 415, January 17, 1992 ]
DIRECTING THE NATIONAL HOUSING AUTHORITY TO IMPLEMENT THE SMOKEY MOUNTAIN DEVELOPMENT PLAN AND UNDERTAKE THE RECLAMATION OF THE AREA ACROSS R-10 AND CREATING AN EXECUTIVE COMMITTEE TO OVERSEE ITS IMPLEMENTATION.
WHEREAS, Memorandum Order No. 161-A mandated the National Housing Authority to conduct feasibility studies and develop low-cost housing projects at the dumpsites of Metro Manila;
WHEREAS, the National Housing Authority has presented a viable Conceptual Plan to convert the Smokey Mountain dumpsite into a habitable housing project inclusive of the reclamation of the area across R-10 as the enabling component of the Project;
WHEREAS, the said Plan requires the coordinated and synchronized efforts of the City of Manila and other government agencies and instrumentalities to ensure effective and efficient implementation;
WHEREAS, the government encourages private sector initiative in the implementation of its project;
NOW, THEREFORE, I, CORAZON C. AQUINO, President of the Republic of the Philippines, by virtue of the powers vested in me by the Constitution and by law, do hereby order and direct:
Section 1. The Smokey Mountain Development Plan and Reclamation of the Area Across R-10 is hereby approved.
Section 2. An Executive Committee is hereby created to oversee the implementation of the Plan, chaired by the NCR-CORD with the heads of the following agencies as members: The National Housing Authority, the City of Manila, the Department of Public Works and Highways, the Public Estates Authority, the Philippine Ports Authority, the Department of Environment and Natural Resources and the Development Bank of the Philippines.
Section 3. The National Housing Authority is hereby directed to implement the Smokey Mountain Development Plan and Reclamation of the Area Across R-10 through a private sector joint venture scheme at the least cost to the government.
Section 4. The land area covered by the Smokey Mountain dumpsite is hereby conveyed to the National Housing Authority as well as the area to be reclaimed across R-10.ᇈWᑭHILp>
Section 5. An Inter-Agency Technical Committee composed of technical representatives of the Executive Committee shall assist the National Housing Authority in the evaluation of joint venture project proposals, monitoring of the actual implementation of the Project, assist in the resolution of all issues and problems arising in the project to ensure that all aspects of development from squatter relocation, waste management, reclamation, environmental protection, land and house construction meets governing regulations of the region and to facilitate completion of the project.
CITY OF MANILA
1. Undertake community information on proposed project.
2. Identify qualified squatter families for permanent socialized housing in coordination with NHA.
3. Facilitate relocation of squatters from Smokey Mountain to temporary housing.
DEPARTMENT OF PUBLIC WORKS AND HIGHWAYS
1. Review of designs and engineering plans of infrastructure works.
PUBLIC ESTATES AUTHORITY
1. Assist in the evaluation of proposals regarding technical feasibility of reclamation.
DEPARTMENT OF ENVIRONMENT AND NATURAL RESOURCES
1. Facilitate titling of Smokey Mountain and of the area to be reclaimed.
2. Assist in the technical evaluation of proposals regarding environmental impact statements.
PHILIPPINE PORTS AUTHORITY
1. Assist in the technical evaluation of port-related land uses in the reclaimed area.
DEVELOPMENT BANK OF THE PHILIPPINES
1. Act as financial advisor to the National Housing Authority.
Section 6. The Executive Secretary shall issue the necessary implementing orders to carry out the provisions of this Memorandum Order.
Section 7. This Memorandum Order shall take effect immediately.
