[ Memorandum Order No. 384, August 8, 1991 ]

EFFECTING THE TRANSFER OF THE OPERATIONS OF THE CATBALOGAN WATERWORKS PROJECT (CWP) TO THE CATBALOGAN WATER DISTRICT (CWD).

WHEREAS, there are two (2) water supply systems operating in Catbalogan, Samar, namely: (1) Catbalogan Water District (CWD); and (2) Catbalogan Waterworks Project (CWP);

WHEREAS, the Catbalogan Water District (CWD) was created in 1978 pursuant to Presidential Decree No. 198, series of 1973, which authorized the formation of local water districts in accordance with the standards prescribed by the Local Water Utilities Administration (LWUA);

WHEREAS, the Catbalogan Waterworks Project (CWP) was one of the USAID-funded water system projects under the Barangay Water Program authorized to operate within a LWUA area, under the supervision of the then Department of Local Government;

WHEREAS, the CWP was maintained and operated by the Catbalogan Rural Waterworks and Sanitation Association (CRWSA), organized in 1986, by virtue of Executive Order No. 577, series of 1980, creating the Rural Waterworks Development Corporation (RWDC);

WHEREAS, pursuant to Section 28(b) of Executive Order No. 124, series of 1987, the Rural Waterworks Development Corporation (RWDC) shall be abolished and its functions and assets transferred to the LWUA in accordance with Sections 29 to 31 thereof;

WHEREAS, the Investigation Committee created by the then Cabinet Action Committee on Implementation Assistance (CACIA), and headed by the Regional Director of the Department of Interior and Local Government, Regional Office No. 8, and with the representatives of LWUA as members, has favorably endorsed the turn-over of the CWP to the CWD;

WHEREAS, as of this date, the functions and assets of CWP have not yet been transferred to CWD;

WHEREAS, to give effect to the mandate of Executive Order No. 124, series of 1987, and to promote an efficient water supply system and services in Catbalogan, Samar, it is imperative that the functions and assets of CWP be immediately transferred to CWD;

NOW, THEREFORE, I, CORAZON C. AQUINO, President of the Philippines, by virtue of the powers vested in me by law, do hereby order:

Section 1. The Local Water Utilities Administration (LWUA) shall oversee the smooth transfer of the functions of the Catbalogan Waterworks Project (CWP) to the Catbalogan Water District (CWD). The transfer of functions shall include appropriations, funds, records, equipment, facilities, choses in action, rights, and other assets and personnel as may be necessary to the proper discharge of the transferred functions.

Section 2. The liabilities of CWP, if any, shall be treated in accordance with the Government Auditing Code and other pertinent laws, rules and regulations.

Section 3. This Memorandum Order shall take effect immediately.1aшphi1
