[ Memorandum Order No. 326, October 15, 1990 ]
DIRECTING THE IMMEDIATE REACTIVATION OF THE 24-HOUR COMPLAINT AND ACTION DESK AT THE NAIA MANNED BY PROSECUTORS AND PROVIDING FOR THE PARTICIPATION OF A REPRESENTATIVE EACH FROM THE GOVERNMENT OFFICES HEREIN MENTIONED
In the interest of the public service and pursuant to the power vested in me by law, I, CORAZON C. AQUINO, President of the Philippines, do hereby order the Secretary of Justice to reactivate the composition of the 24-hour Complaint and Action Desk at the Ninoy Aquino International Airport created under a Joint Circular dated August 27, 1987 of the Departments of Justice, Tourism and Finance, and the Manila International Airport Authority. The National Bureau of Investigation, Bureau of Immigration, Bureau of Customs, Central Bank of the Philippines, Economic Intelligence and Investigation Bureau, Narcotics Command, and the Philippine Air Force Security Command shall assist in the relentless drive of the government in curbing the rampant criminal activities occurring at the airport that have reached an alarming stage so that the same shall be a coordinated concern of all government agencies operating at the airport complex.
All agencies at the NAIA, namely, Departments of Finance and Tourism, the Manila International Airport Authority, National Bureau of Investigation, Bureau of Customs, Bureau of Immigration, Central Bank of the Philippines, Narcotics Command, and the Philippine Air Force Security Command are hereby directed to indorse to the Complaint and Action Desk, within twenty-four (24) hours from the time of apprehension, all violations of laws and/or their respective rules and regulations of which they are tasked to enforce or implement.
The Complaint and Action Desk upon receipt of a complaint from the government agencies concerned, shall refer the same to the Prosecutors on duty who shall exercise direct control in the conduct of the:
a) Inquest
b) Preliminary investigation
c) Prosecution in court if there is a probable cause or the evidence so warrants.
All government agencies, officials and employees at the Ninoy Aquino International Airport are hereby directed to coordinate and cooperate in the implementation of this Memorandum Order.1aшphi1
The Secretary of Justice is hereby authorized to promulgate such rules and regulations and/or operational guidelines defining the role of each agency in connection with the operation of the Complaint and Action Desk and the investigation and prosecution of offenses committed at the airport complex.
This Memorandum Order shall take effect immediately.
