[ Memorandum Order No. 302, June 18, 1990 ]
DIRECTING THE LAND TRANSPORTATION OFFICE TO ISSUE OR RENEW CERTIFICATES OF REGISTRATION OF MOTOR VEHICLES FOR HIRE ONLY UPON PROOF OF PAYMENT OF THE COMMON CARRIERS TAX UNDER THE NATIONAL INTERNAL REVENUE CODE
WHEREAS, it has been observed that certain common carriers by land are registered by the Land Transportation Office and continue to operate even without the payment of the common carriers tax provided for under Section 115 of the National Internal Revenue Code, as amended;
WHEREAS, there is a need to effectively administer the said tax in order to improve the revenue performance and ease the current budgetary difficulties of the government;
NOW, THEREFORE, I, CORAZON C. AQUINO, President of the Philippines, by virtue of the powers vested in me by law, do hereby order:
Section 1. The Land Transportation Office is hereby ordered and directed to issue or renew certificates of registration of any motor vehicles used in the business of transporting passenger or freight which are subject to the common carriers tax under Section 115 of the National Internal Revenue Code, as amended, only upon presentation of a certificate from the Bureau of Internal Revenue evidencing payment of the common carriers tax of the preceding taxable year.
Section 2. The Secretary of Finance, in consultation with the Secretary of Transportation and Communications and upon the recommendation of the Commissioner of Internal Revenue, shall promulgate the necessary rules and regulations to implement this Memorandum Order.
Section 3. This Memorandum Order shall effect fifteen (15) days after the publication of the rules and regulations promulgated pursuant to Section 2 hereof.1aшphi1
