[ Memorandum Order No. 36, September 10, 1986 ]

CLARIFYING THE MEMORANDUM DATED MARCH 26, 1986 TO SPECIFICALLY INCLUDE PAYMENT OF SEPARATION PAY TO OFFICIALS AND EMPLOYEES OF THE BATASANG PAMBANSA SECRETARIAT.

WHEREAS, the Memorandum of the Office of the President dated March 26, 1986 on the winding up of the affairs of the Batasang Pambansa provides that “employees of the Batasang Pambansa shall be entitled to retirement and other benefits if qualified under existing laws”;

WHEREAS, there are about 514 personnel of the defunct Batasan Secretariat who are not entitled to retirement benefits;

WHEREAS, these affected personnel are otherwise entitled to separation pay;

ACCORDINGLY, it is hereby clarified that in accordance with Section 3 of Article III of Proclamation No. 3, all officials and employees of the Batasang Pambansa Secretariat who were separated from the service, but who are not entitled to or eligible for retirement under existing laws, shall be granted a separation pay at a rate equivalent to one month’s salary for every year of continuous service rendered or the equivalent nearest fraction thereof favorable to them on the basis of the highest salary received, which in no case should exceed a total of 12 months salary nor less than one month salary.

The amount necessary to pay the required separation pay shall be charged against the savings of the defunct Batasang Pambansa.1aшphi1

The Ministry of Budget and Management is directed to implement this Order.

This Order shall take effect immediately.
