[ MEMORANDUM ORDER NO. 438, July 10, 1974 ]

AMENDING MEMORANDUM ORDER NO. 395, DATED OCTOBER 19, 1973, “CREATING A COMMITTEE TO STUDY WAYS AND MEANS TO ENCOURAGE PUBLIC UTILITY VEHICLE DRIVERS TO ORGANIZE THEMSELVES INTO COOPERATIVES.”

WHEREAS, Memorandum Order No. 395, issued by this Office on October 19, 1973, created a committee to study ways and means to encourage public utility vehicle drivers to organize themselves into cooperatives;

WHEREAS, commensurate with its limited capabilities and resources the Committee thus created has so far concentrated its thrust of organizing pilot transport service cooperatives in the Metropolitan Manila Area;

WHEREAS, in view of the very favorable nationwide response to the idea of transport cooperatives formation, many drivers1 groups have sought the help of the said Committee to assist in the establishment of cooperatives in their respective localities, in many other areas of the country; and

WHEREAS, it is necessary that not only the drivers but transport operators and public utility vehicle owners as well should be encouraged into joining hands with their drivers in the establishment of said cooperatives:

WHEREFORE, consistent with the guidelines promulgated in Memorandum Order No. 395, above-cited, the title of this Order is hereby amended to read as follows:

“CREATING A COMMITTEE TO STUDY WAYS AND MEANS TO ENCOURAGE AND ASSIST PUBLIC UTILITY VEHICLE DRIVERS, OWNERS AND OPERATORS TO ORGANIZE THEMSELVES INTO COOPERATIVES.”

As a consequence hereof, paragraph a) of Memorandum Order No. 395 is amended to read as follows:

“a) To supervise and facilitate the early formation and establishment of public utility vehicle drivers, operators and/or owners cooperatives.”

Moreover, the Committee is hereby authorized to expand its activities into a wider coverage. Specifically, it shall take into consideration the requests being received at this Office particularly from drivers and public utility vehicle operators groups in the outlying provinces and cities, who also desire and seek to avail of government guidance and assistance to form and establish transport cooperatives in their respective areas of operation; but with the Metropolitan Manila as priority area for transport cooperatives formation and establishment.1aшphi1

Furthermore, the Committee is hereby authorized to call upon any official or entity of the government, both national and local, in the respective localities where such transport service cooperatives may be established, for such assistance and material support as may be necessary for the successful and efficacious implementation of this Order.

This Order takes effect immediately.
