CREATING A COMMITTEE TO DRAFT A MEMORANDUM AGREEMENT AMONG THE PROVINCIAL GOVERNOR OF BATAAN, THE MUNICIPAL MAYOR MARIVELES AND THE EXPORT PROCESSING ZONE AUTHORITY (EPZA) PERTAINING TO THE ADMINISTRATION OF GOVERNMENTAL AFFAIRS OVER THE BARRIOS OF NASSCO, CAMAYA AND SISIMAN, ALL IN MARIVELES, BATAAN.
WHEREAS,Presidential Decree No. 66 dated November 20, 1972, created an Export: Processing Zone Authority (EPZA) to carry out the policy of the Government to encourage and promote foreign commerce as a means of making the Philippines a center of international trade, of strengthening our export trade and foreign exchange position, of hastening industrialization, of reducing domestic unemployment, and of accelerating the development of the country;
WHEREAS,one of the specific powers of the EPZA is to exercise, exclusive jurisdiction and zone police authority over, all areas owned or administered by the EPZA;
WHEREAS,the barrios of Nassco, Camaya and Sisiman, all in Mariveles Bataan, fall within the export processing zone and are thus subject to the jurisdiction of the EPZA
WHEREAS,while it is clear that the areas concerned fall within the zone police authority of the EPZA, the matter pertaining to the administration of governmental affairs in the said barrio is quite vague and undefined;
WHEREAS,the above circumstance presents an apparent conflict between the exercise of power by the EPZA on the one hand and by the Provincial Government of Bataan and the “Municipal Government of Mariveles on the other over the said barrios, and that there is an urgent need to resolve the matter;
WHEREFORE, there is hereby created a Committee to draft a Memorandum of Agreement among the Provincial Governor of Bataan, the Municipal Mayor of Mariveles and the EPZA pertaining to the administration of governmental affairs in the said barrios. The Committee shall be composed of the following:

The proposed draft of agreement to be prepared by the Committee shall include provisions on the following: law and order; health and sanitation; the right of suffrage of the residents; education; taxation and licensing of establishments; the relocation of residents; and such other matters affecting the welfare and interest of the residents.
The Committee may call upon any department, bureau or office for such assistance as it may need in the accomplishment of its mission. It shall complete its work within a period of thirty (30) days from the date hereof.
