REQUIRING THE SUBMISSION OF CERTAIN DOCUMENTS AND THE INCORPORATION OF CERTAIN PROVISIONS IN SECURITY AND JANITORIAL CONTRACT AWARDS

It has come to the attention of this Office that most private security and janitorial services agencies with contracts with the Government have been underpaying their employees and have failed to remit their workers’ contributions to the Social Security System (SSS).1aшphi1

To ensure compliance with the requirements on the minimum wage and on the compulsory SSS remittances, all departments, bureaus, agencies, and instrumentalities of the Government shall forthwith require security and janitorial service contractors to submit, as part of the bid or tender documents, the following:

1. An undertaking to pay their workers at least the minimum wage,

2. An undertaking to comply with the SSS law on compulsory remittance of SSS premiums, and

3. A clearance from the Department of Labor and Employment and the SSS, as the case may be, that the contractor or the bidder has no pending administrative case for violation of the SSS and minimum wage laws, rules and regulations.

In addition, contracts for security and janitorial services shall include stipulations to cover matters contemplated in (1) and (2) above.1aшphi1
