CLARIFYING SECTION 3 OF ADMINISTRATIVE ORDER NO. 40, AS AMENDED BY ADMINISTRATIVE ORDER NO. 55, S. 1993

In order to ensure the proper and uniform implementation of Administrative Order No. 40, as amended by Administrative Order No. 55 S. of 1993, the following clarifications are hereby issued for the information and guidance of all concerned:

Service-connected crimes or offenses which shall be tried by court-martial referred to in Section 3 of Administrative Order No. 40, as amended, pertain to service-connected crimes or offenses committed by Members of the Armed Forces of the Philippines and other persons subject to military law, including members of the Citizens Armed Forces Geographical Units as provided for in Republic Act No. 7055.1aшphi1

Criminal cases involving members of the Philippine National Police remain within the exclusive jurisdiction of the regular courts in accordance with the terms of Republic Act No. 6975 otherwise known as the Department of the Interior and Local Government Act of 1990, specifically Section 46 thereof.
