PROHIBITING THE DESIGNATION OF OFFICER-IN-CHARGE IN GOVERNMENT OFFICES EXCEPT BY THE PRESIDENT

It has been noted that certain officials of the government have been designated as Officers-In-Charge by the regular incumbents who are presidential appointees to act in their stead during their temporary absence without oven securing the prior clearance or approval of the President. This practice is tantamount to asurption of the power of appointment of the President which cannot be delegated even by him and therefore such designations or appointments suffer from constitutional infirmity.

It is therefore hereby directed that henceforth, regular incumbents of government offices who are presidential appointees shall refrain from making designations of officers-in-charge in any government office to act for them during their temporary absence. All such designations or appointments shall be made by the President
