ENJOINING STRICT COMPLIANCE WITH MEMORANDUM CIRCULAR NO. 210 DATED OCTOBER 29, 1968, ENTITLED PROMULGATING RULES GOVERNING THE CONTROVERSION OF COMPENSATION CASES INVOLVING THE GOVERNMENT AS AN EMPLOYER.”

It has been reported by the Office of the Solicitor General that there are still government offices that do not comply strictly with Memorandum Circular No. 210 of Malacañang dated October 29, 1968, particularly with respect to the filing of an Employer’s Report within the periods provided by section 45 of the Workmen’s Compensation Act, and the controversion of a claim in the manner prescribed by law.

In order that the Office of the Solicitor General may be able to protect and defend effectively and successfully the interests of the government in these cases, strict compliance with Memorandum Circular No. 210, particularly the following provisions thereof, is enjoined:

1. Submission of the Employer’s Report and Notice of Controversion by the head of office or agency concerned or by the head of the regional offices or branches directly to the proper Regional Office of the Department of Labor within the periods provided for in section 45 of the Workmen’s Compensation Act, furnishing the Office of the Solicitor General with a copy thereof.

2. Specific statement of the ground or grounds for controversion in order that the same may be considered a valid controversion.1âшphi1

3. Creation of the compensation evaluation committee that will act immediately on claims filed under the Workmen’s Compensation Act.

The Solicitor General, as counsel for the government, may determine the propriety of a controversion registered by a government agency or office and may withdraw the same on grounds he may deem proper under the circumstance.
