[ Memorandum Circular No. 600, October 4, 1972 ]

DIRECTING ALL LOCAL GOVERNMENTS TO CONTINUE FUNCTIONING IN ACCORDANCE WITH EXISTING LAWS UNLESS OTHERWISE ORDERED AND ENJOINING LOCAL ELECTIVE OFFICIALS WHO ARE NEXT IN RANK TO SUCCEED AND ASSUME OFFICES OF SENIOR OFFICIALS IN CASE OF THE LATTER’S INCAPACITY TO PERFORM THEIR DUTIES PURSUANT TO SECTION 17 OF THE ELECTION CODE 1971 (Rep. Act No. 6388).

WHEREAS, on September 22, 1972, General Order No. 3 was issued pursuant to Proclamation No. 1081, dated September 21, 1972, decreeing that “henceforth all executive departments, bureaus, offices, agencies and instrumentalities of the National Government, government-owned or controlled corporations, as well as all governments of all provinces, cities, municipalities and barrios throughout the land shall continue to function under their present officers and employees and in accordance with existing laws, until otherwise ordered by me (the President) or by my (his) duly designated representative.”

NOW, THEREFORE, for the proper guidance of all Provincial Governors, City Mayors, Municipal and Municipal District Mayors, Barrio Captains and other local officials, Proclamation No. 1081 and other presidential issuances are hereby circularized:

I. General Orders Nos. 1, 2, 3, 4, 5, and 6, all dated September 22, 1972;

No. 7 dated September 23, 1972;

No. 3-A dated September 24, 1972;

No. 2-A dated September 26, 1972

No. 8 dated September 27, 1972;

No. 9 dated September 27, 1972;

Nos. 7-A, 12, and 13 all dated September 30, 1972.

II. Letters of Instructions Nos. 1, 2, 3, 4, 5, 6, and 7 all dated September 22, 1972

No. 8 dated September 24, 1972;

No. 9 dated September 26, 1972;

No. 13 dated September 29, 1972;

Nos. 14 and 15 both dated September 29, 1972 and

Nos. 16 and 17 both dated October 1, 1972.

III. Presidential Decrees No. 1 dated September 24, 1972;

No. 2 dated September 26, 1972;

No. 7 dated October 1, 1972

Nos. 9 and 10 both dated October 2, 1972; and

Nos. 11 and 12 both dated October 3, 1972.

The contents of the above-specified presidential issuances are to be disseminated to the general public and officials and employees concerned.

In connection with the above and in view of the arrest and detention of some local elective officials for various reasons, which detention shall continue for the duration of the emergency unless ordered released by the President or his duly designated representative, and considering reports received in the Office of the President that notwithstanding the temporary detention of such local elective officials, those who are next in rank, for some reason or another, have failed to assume the offices temporarily vacated, all local elective officials who are next in rank to those temporarily detained are hereby directed to succeed and assume such vacant offices until the resumption of office of the incumbent pursuant to General Order No. 3 dated September 22, 1972 and in consonance with Section 17 of the Election Code of 1971 (RA 6388). All are enjoined to comply strictly with the above; otherwise they will be dealt with in accordance with existing laws.

All concerned are hereby directed to act accordingly.
