[ Memorandum Circular No. 338, March 30, 1970 ]

AMENDING MEMORANDUM CIRCULAR NO. 201 DATED AUGUST 23, 1969, WHICH PRESCRIBED THE RULES AND REGULATIONS ON THE PAYMENT OF REWARD FOR THE CAPTURE/ARREST OR SURRENDER OF WANTED CRIMINALS/POLICE CHARACTERS AND THE CONFISCATION OF LOOSE/ILLEGALLY USED OR CARRIED FIREARMS.

The following Sections of Memorandum Circular No. 201 dated August 23, 1969, are hereby amended to read as follows:

“3. Reward Committee.-There shall be created under the Office of the Peace and Order Coordinating Council an assessment and evaluation body to be known as the “Reward Committee,” hereinafter referred to as the Committee, which shall have the sole function of fixing the amount of reward to be awarder, the person or persons entitled to it and to determination of facts entitling the claimant to the reward. The amount of reward in any case shall not be less than FIVE HUNDRED PESOS (P500.00) nor more than FIVE THOUSAND PESOS (P5,000.00) except that in case of information leading to the confiscation of loose/illegally used/carried firearms, the range of the cash reward shall be from Thirty Pesos (P30.00) to ONE HUNDRED PESOS (P100.00) in any case. The Reward Committee shall be composed of the following:

Chief of Police, QCPD Member

The findings and recommendations of the Committee shall be subject to the approval of the Chairman or any council member duly designated by the Peace and Order Coordinating Council, and once approved, shall constitute as final authority fir the payment of the reward.

“The Reward Committee is hereby authorized to create as many subcommittees as may be necessary to assist in the assessment and evaluation of any claim for reward.

“The NBI, the PC and the local chief of police shall assist and cooperate with the Committee in the processing of claims for reward.

“The Committee is likewise authorized to promulgate additional rules and regulations to implement this Memorandum Circular.”

“4. Guidelines in Processing Claims:

a. The claim shall be made in writing and under oath, to be deliberated upon and paid within one (1) month from receipt thereof by the Committee. Approved claims which remain unpaid after the end of a fiscal year should be reported as outstanding obligation in that year.

The full amount of the approved cash reward shall be paid to any person who captures or effects the surrender of a wanted criminal/police character/outlaw or one who acted as guide in the killing, surrender or arrest of a wanted person. If the claimant’s participation is in the form of supplying information, he shall receive fifty per centum (50%) of the amount approved.1âшphi1

d. The Committee shall equitably apportion the reward among persons entitled thereto should there be more than one, taking into consideration the pertinent guidelines embodied in the Circular. In case there are two or more conflicting claimants, the Committee shall make a thorough investigation of the claims to decide who is/are the rightful claimants and the proprortionate amount of rewards that should be paid to each of them.

e. No payment shall be authorized in each case until final determination is made by the Committee. Additional reward may be made under proper circumstances.”

This Circular shall take effect immediately.
