CLARIFYING THE EFFECT OF EXECUTIVE ORDER NO. 218, CURRENT SERIES, ON THE POLICY ON FILLING OF POSITIONS AND APPOINTMENTS.
As an economy measure in the pursuance of the fiscal restraint policy, this Office issued Memorandum Circular No.328 dated February 19, 1970 (amended by Memorandum Circular No. 328 dated March 9, 1970), prohibiting the filling of vacant positions except those mentioned therein; and in Executive Order No. 218 dated March 21, 1970, the authority to fill positions has been delegated to the heads of department with respect to those in the Appropriations Act and to Provincial Boards and City Councils as regards positions vacated on account of retirement or suspension of local officials and employees.1âшphi1
It should be, as it is herein, clarified that the provisions of Executive Order No. 218 are merely a delegation of the powers previously exercised by the President and are not intended to slacken or relax, in any degree, the retrenchment policy of the Administration. In other words, the department heads and other appointing officials and the Provincial Boards and City Council concerned shall, and are hereby enjoined to, strictly observed the prohibition against the filling of positions. In the cases falling under the exceptions specified in the Circular, attention is directed to the injunction in the last paragraph thereof against the issuance of retroactive appointments.
Heads of departments and other appointing officers and provincial boards and city councils shall, effective immediately, submit monthly reports to this Office on appointments issued in their respective jurisdictions which shall contain, among other things, the names and the appointees, their positions and salary rates, and the effective dates of the appointments.
