[ Memorandum Circular No. 335, March 19, 1970 ]

ENJOINING STRICT COMPLIANCE WITH MEMORANDUM CIRCULAR NO. 309, SERIES OF 1968.

Memorandum Circular No. 309 of the Office dated December 26, 1969, entitled “ENJOINING HEADS OF GOVERNMENT OFFICES AND ENTITIES FROM PROPOSING THE EXTENSION IN THE SERVICE OF AN EMPLOYEE AFTER THE AGE OF 65 YEARS,” provides in the penultimate paragraph thereof the following:

“The heads of the various government offices and entities are therefore hereby enjoined from making such proposals unless absolutely necessary in the interest of the service and only in cases of officials and employees with specific qualifications. In order to preclude the necessity of extension, it is desired that understudies and/or automatic and compulsory retirement, at least six months prior to the date thereof.”

Notwithstanding the aforequoted provision, this Office still continues to receive extension proposals that do not meet the requirements of law and pertinent policy pronouncements.1âшphi1

Since it is imperative that the policy be strictly enforced and complied with except in cases where the conditions stipulated in Commonwealth Act No. 186, as amended by Republic Act No. 4968 and complemented by the said Memorandum Circular No. 309 are clearly met, strict observance by all concerned of the policy as enunciated is hereby again strongly enjoined.
