SUPPLEMENTING MEMORANDUM CIRCULAR NO. 305 OF THIS OFFICE DATED NOVEMBER 24, 1969.

Memorandum Circular No. 305 of this Office dated November 24, 1969, entitled “LIMITATIONS ON CERTAIN MATTERS RELATIVE TO APPOINTMENT PROPOSALS SUMBITTED TO THE OFFICE OF THE PRESIDENT UNDER ADMINISTRATIVE ORDER NO. 171, SERIES OF 1956,”prohibits appointing authorities from allowing a proposed appointee to assume the duties of the position to which he is proposed for appointment unless the corresponding proposal required under Administrative Order No. 171, series of 1956, has been approved by this Office.

Despite the prohibition, this Office has noted that in some cases where appointment proposals have been disapproved, the nominees concerned are nevertheless allowed to discharge the duties of the position either by designation or other arrangement. This act constitutes a circumvention of the disapproval by this Office of the appointment proposal; a patent discharged of the limitation imposed by Memorandum Circular No. 305; and a deprivation of other employees of the chance to be considered for appointment to the positions involved. Such situations cannot therefore be tolerated.

All appointing authorities are therefore hereby enjoined not only to observe strictly the aforementioned prohibition but, more so, not allow proposed appointees to assume the duties of the positions where the corresponding appointment proposals have been disapproved by this Office. Existing cases not in conformity herewith should accordingly be corrected immediately.

This Memorandum Circular shall take effect immediately.1âшphi1
