GENERAL RELEASE OF PUBLIC STREAMS NOT NEEDED BY THE NATIONAL POWER CORPORATION FOR POWER DEVELOPMENT UNDER THE PROVISIONS OF SECTION 9 OF COMMONWEALTH ACT NO. 120.

WHEREAS, the acquisition of a water rights concession is a legal requirement before any person or group of persons or juridical entity could utilize public waters for any purpose;

WHEREAS, before a water rights application may be granted, several legal processes and steps are to be taken, among which is the release from reservation of the public stream subject of the application in accordance with the provisions of Section 19 of Commonwealth Act No. 120; and

WHEREAS, due to these legal steps and processes, the granting of water rights concession is delayed, thereby discouraging water rights applicants in their pursuit for economic development specially in the field of agriculture;

WHEREFORE, to avoid unnecessary delay in the processing of water rights applications and in line with the rice and corn crash program of the administration, the National Power Board of the National Power Corporation and the Secretary of Public Works and Communications are hereby ordered to certify immediately the release from reservation in accordance with the provisions of Section 9 of Commonwealth Act 120, of all public streams net considered potentially serviceable for power development, for approval by this Office.
