[ EXECUTIVE ORDER NO. 104, November 06, 2025 ]

TEMPORARILY MODIFYING THE RATE OF IMPORT DUTY ON TIN-MILL BLACKPLATE

WHEREAS, Section 13, Article XII of the Constitution provides that the State shall pursue a trade policy that serves the general welfare;

WHEREAS, Section 1608 of Republic Act (RA) No. 10863 or the "Customs Modernization and Tariff Act" empowers the President, in the interest of general welfare and national security, ad upon recommendation of the Department of Economy, Planning and Development (DEPDev), to increase, reduce, or remove existing rates of import duty;

WHEREAS, Tin-Mill Blackplate (TMBP) serves as the main material in the production of Tin Place (TP) and Tin-Free Steel (TFS), which are primarily used in the canned food industry;

WHEREAS, at present, there is no local production of TMBP, and there is also no local product that can substitute for said commodity;

WHEREAS, according to the Economy and Development (ED) Council, temporarily modifying the rate of import duty on TMBP will revitalize domestic TP and TFS industries and promote consumer welfare by stabilizing the supply chain, lowering production, costs, generating employment, and fostering a favorable environment for investments; and

WHEREAS, on 20 August 2025, the ED Council endorsed the reduction of the Most Favored Nation (MFN) tariff rat on TMBP;

NOW, THEREFORE, I, FERDINAND R. MARCOS, JR., President of the Philippines, by virtue of the powers vested in me by the Constitution and existing laws, do hereby order:

Section 1. Rates of Import Duty. The articles specifically listed in Annex A hereof, as classified in compliance with Section 1611 of RA No. 10863, shall be subject to the MFN rates of duty in accordance with the schedule indicated opposite the articles.

Upon the effectivity of this Order, the articles specifically listed in Annex A hereof, which are entered or withdrawn from warehouses in the Philippines for consumption shall be levied the MFN rates of duty as prescribed therein.

The rates of import duty on tariff headings and subheadings which are not listed in Annex A hereof, and those listed but represented by the symbol "X X X" shall remain in full force and effect.

Section 2. Review. The MFN tariff rate shall be subject to a review after one (1) year of implementation of this Order. For this purpose, the DEPDev shall submit to the President, through the Office of the Executive Secretary, its findings and recommendations on the matter, including the analysis and monitoring results of the TMBP market.

Section 3. Repeal. All other issuances, administrative rules and regulations, or parts thereof, which are inconsistent with this Order are hereby repealed or modified accordingly.ℒαwρhi৷

Section 4. Separability. If any provision or part of this Order is declared invalid or unconstitutional, the other provisions not affected thereby shall remain valid and subsisting.

Section 5. Effectivity. This Order shall take effect thirty (30) days after its complete publication in the Official Gazette or in a newspaper of general circulation, and shall be in full force and effect for a period of three (3) years from the date of effectivity.
