[ EXECUTIVE ORDER NO. 101, October 25, 2025 ]
DIRECTING THE FULL IMPLEMENTATION OF REPUBLIC ACT NO. 11321 OR THE "SAGIP SAKA ACT"
WHEREAS, Section 9, Article II of the Constitution provides that the State shall promote a just and dynamic social order that will ensure prosperity and independence of the nation and free the people from poverty through policies that provide adequate social services, promote full employment, a rising standard of living, and an improved quality of life for all;
WHEREAS, Section 3 of Republic Act (RA) No. 11321 or the "Sagip Saka Act" established the Farmers and Fisherfolk Enterprise Development (FFED) Program for purposes of providing various forms of assistance to farmers and fisherfolk to reach their full potential, increase their income, and improve their quality of life;
WHEREAS, Section 6 of RA No. 11321 designated the Department of Agriculture (DA) as the implementing agency of the FFED Program;
WHEREAS, Section 8 of RA No. 11321 created the FFED Council to oversee the implementation of the FFED Program;
WHEREAS, to promote and support enterprise development of farmers and fisherfolk, Section 11 of RA No. 11321, mandates national and local government agencies to directly purchase agricultural and fishery products from accredited farmers and fisherfolk cooperatives and enterprises (FFCEs), provided that said agricultural and fishery products are necessary in the performance of their respective mandates;
WHEREAS, based on the Poverty Incidence Survey released by the Philippine Statistics Authority on 31 March 2025, farmers and fisherfolk sectors remain among the sectors with highest poverty incidence in 2021 to 2023;
WHEREAS, to uplift the lives of Filipino farmers and fisherfolk, there is a need to direct all national government agencies (NGAs) and instrumentalities, including government-owned or -controlled corporations (GOCCs) and state universities and colleges (SUCs), and local government units (LGUs) to fully implement RA No. 11321; and
WHEREAS, Section 17, Article VII of the Constitution vests in the President the power of control over all Executive departments, bureaus and offices, and the mandate to ensure the faithful execution of laws;
NOW, THEREFORE, I, FERDINAND R. MARCOS, JR., President of the Philippines, by virtue of the powers vested in me by the Constitution and existing laws, do hereby order:
Section 1. Implementation of Sagip Saka Act. Subject to existing laws, rules and regulations, all NGAs and instrumentalities, including GOCCs and SUCs are hereby directed, and LGUs are hereby enjoined to fully implement RA NO. 11321 to promote and support local farmers and fisherfolk.
In this regard, all NGAs and instrumentalities, including GOCCs and SUCs shall align their programs, activities, and projects (PAPs) aimed to supporting the objectives of RA No. 11321, among which are as follows:
a. Institutional procurement of agricultural products from FFCEs with equal opportunity to small farmers and fisherfolk;
b. Establishment of capacity-building programs for FFCEs and LGUs to strengthen local economic development for agriculture;
c. Enhancement of collaboration with programs aimed at promoting farmers and fisherfolk development, such as the KADIWA ng Pangulo and Department of Social Welfare and Development Food Stamp Program, among others;
d. Strengthening the monitoring, evaluation, and innovation mechanisms under the FFED Program;
e. Implementation of exemptions and incentives under Section 12 of RA No. 11321 for eligible beneficiaries;
f. Crafting of Enterprise Capacity Development Plans which will serve as multi-year roadmaps for strengthening enterprise operations of farmer and fisherfolk cooperatives and associations; and
g. Application and registration of FFCEs in the Farmers and Fisherfolk Enterprise Development Information System (FFEDIS) to avail of the benefits and services under RA No. 11321.
Further, in addition to their obligations under Section 10, 11, and 12 of RA No. 11321, LGUs are hereby encouraged to render support and cooperation to DA and all other concerned agencies for the efficient and effective implementation of RA No. 11321.
Section 2. Direct Purchase by National and Local Government. Pursuant to Section 11 of RA No. 11321, all NGAs and instrumentalities, including GOCCs and SUCs are hereby directed, and LGUs are hereby enjoined to purchase agricultural and fishery products directly from FFCEs in the implementation of their PAPs, including those undertaken for disaster preparedness and prepositioning of goods, in accordance with existing laws, rules and regulations. Said procurement shall be exempted from the application of the bidding process, subject to negotiated procurement prescribed under RA No. 12009 or the "New Government Procurement Act" and other existing laws, rules and regulations.
Further, all NGAs and instrumentalities, including GOCCs and SUCs, are hereby directed, and LGUs are hereby encouraged, to ensure that rice and other agricultural and fishery products served in government events, food service areas or canteens are directly purchased from accredited FFCEs to promote the consumption of locally produced food and support small producers.
In instances where there is no local production of agricultural and fishery products or whenever the supply thereof is insufficient, concerned NGA and LGU shall directly pruchase from accredited FFCEs located in the other localities. For this purpose, said NGA and LGU shall prioritize sourcing the products from the nearest locality, provided that it will not disrupt food production of said locality.
Section 3. Convergence. All concerned government agencies are hereby directed, and LGUs are hereby encouraged, to collaborate with DA< the private sector, civil society organizations, academe, and development partners to ensure inclusive, coordinated, and sustainable implementation of RA No. 11321.
Such convergence shall support enterprise development, capacity-building, market access, and other initiatives that contribute to the empowerment of farmers and fisherfolk.
Section 4. Establishment of Sagip Saka Desks. The DA is hereby directed to establish a Sagip Saka Desks in its regional and field offices to serve as hubs for information, assistance and coordination, including:
a. Registration of farmers and fisherfolk in the FFEDIS;
b. Distribution of information, education, and communication materials about RA No. 11321; and
c. Provision of assistance related to enterprise development, participation in direct purchase, completion of relevant requirements, and other programs under RA No. 11321.ℒαwρhi৷
Section 5. Supplemental Guidelines. The FFED Council is hereby authorized to issue supplemental guidelines to the Implementing Rules and Regulations of RA No. 11321 and other relevant guidelines issued by DA.
Section 6. Monitoring. To ensure effective implementation of this Order, the FFED Council shall monitor its implementation.
Section 7. Reporting. The FFED Council shall submit to the President, through the Office of the Executive Secretary, a bi-annual report that shall include, among others, the accomplishments, activities, and initiatives undertaken by NGAs and LGUs for the implementation of RA No. 11321.
Section 8. Funding. The funding requirements for the initial implementation of this Order shall be charged against the existing appropriations of concerned agencies, subject to relevant budgeting, accounting, and auditing laws, rules and regulations. Thereafter, the subsequent funding requirements for the continued implementation of this Order shall be included in the budget proposals of concerned agencies, subject to the usual budget preparation process.
Additional funding may likewise be sourced by concerned agencies from official development assistance, public-private partnerships, and other financing mechanisms to implement RA No. 11321, subject to existing laws, rules and regulations.
Section 9. Separability. If any or provision of this Order shall be held unconstitutional or invalid, the other provisions not affected thereby shall continue to be in full force and effect.
Section 10. Repeal. All orders, rules and regulations, and other issuances or parts thereof which are inconsistent with the provisions of this Order, are hereby repealed or modified accordingly.
Section 11. Effectivity. This Order shall take effect immediately upon publication in the Official Gazette or in a newspaper of general circulation.
