[ EXECUTIVE ORDER NO. 60, May 13, 2024 ]

REORGANIZING THE PHILIPPINE CROP INSURANCE CORPORATION AND TRANSFERRING ITS ATTACHMENT FROM THE DEPARTMENT OF FINANCE TO THE DEPARTMENT OF AGRICULTURE

WHEREAS, Section 1 of Presidential Decree (PD) No. 1467, as amended by PD No. 1733 and Republic Act (RA) 8175 or the "Revised Charter of the Philippine Crop Insurance Corporation (PCIC) Act of 1995," created the PCIC, a government-owned or -controlled corporation (GOCC) tasked to provide insurance protection to farmers against losses arising from natural disasters, plant diseases, and pest inflation;

WHEREAS, pursuant to Executive Order (EO) No. 148 (s. 2021), the PICC is attached to the Department of Finance for policy and program coordination and general supervision;

WHEREAS, Section 2, Chapter 1, Title IV, Book IV of EO No. 292 (s. 1987) or the "Administrative Code of 1987" mandates the Department of Agriculture (DA) to promote the country's agricultural development by providing policy framework, public investments, and support services necessary for the advancement of the agricultural sector;

WHEREAS, a strong organizational link between the PCIC and DA is necessary to enhance agricultural insurance protection highly responsive to the needs of small farmers and fisherfolk and other agricultural stakeholders, with policies and programs aimed at ensuring food security and modernization of the agricultural sector;

WHEREAS, streamlining and rationalizing the functional relationships of agencies with complementary mandates is essential to fostering organizational coherence, efficiency, and cooperation within the bureaucracy;

WHEREAS, Section 42, Chapter 9, Book IV of EO No. 292, provides that a GOCC shall be attached to the appropriate department with which they have allied functions in order to fulfill their complementary governmental mandates; and

WHEREAS, Section 17, Article VII of the 1987 Constitution vests in the President the power of control over all Executive departments, bureaus and offices, and the mandate to ensure the faithful execution of laws;

NOW, THEREFORE, I, FERDINAND R. MARCOS, JR., President of the Philippines, by virtue of the powers vested in me by the Constitution and existing laws, do hereby order:

Section 1. Attachment of PCIC. The PCIC is hereby attached to the DA for policy and program coordination.1aшphi1

Section 2. Composition of the PCIC Board. In accordance with PD No. 1467, as amended, the PCIC Board is hereby reorganized and shall now be composed of the following:

a. President of the Land Bank of the Philippines;

b. President of the PCIC;

c. Executive Director of the Agricultural Credit Policy Council;

d. One (1) representative from the private insurance industry, appointed by the President upon nomination by the Secretary of Finance; and

e. Three (3) representatives from the subsistence farmers' sector, preferably representing agrarian reform beneficiaries, cooperatives or associations from Luzon, Visayas, and Mindanao, appointed by the President upon their nomination by different farmer organizations and/or cooperatives.

The appointment or designation of the Chairperson, Vice-Chairperson, and other officers of the Board of Directors shall be in accordance with RA No. 10149 or the "GOCC Governance Act of 2011."

Section 3. Separability. If any part or provision of this Order shall be held invalid or unconstitutional, the provisions not affected thereby shall remain in full force and effect.

Section 4. Repeal. EO No. 148 is hereby repealed. All orders, rules and regulations, and other issuances or parts thereof which are inconsistent with the provisions of this Order, are hereby repealed or modified accordingly.

Section 5. Effectivity. This Order shall take effect immediately.
