CREATING THE LAGUNA LAKE REHABILITATION PROJECT MANAGEMENT OFFICE UNDER THE RIVER BASIN CONTROL OFFICE OF THE DEPARTMENT OF ENVIRONMENT AND NATURAL RESOURCES AND DEFINING ITS SCOPE AND RESPONSIBILITIES

WHEREAS, Section 4 of Executive Order (EO) No. 192, series of 1987, mandated the Department of Environment and Natural Resources (DENR) as the primary government agency responsible for the conservation, management, and development of the country’s environment and natural resources, as well as their proper use, and shall ensure the equitable sharing of the benefits derived therefrom for the welfare of the present and future generations of Filipinos;

WHEREAS, Executive Order No. 510 dated March 5, 2006 mandates the RBCO under the DENR to rationalize various river basin projects such as, but not limited to, the following: the Pasig River Rehabilitation, KAMANAVA flood control, Agno River and Allied Rivers Flood Control, and to promote and advocate an integrated river basin management to ensure protection of environment and people against floods and natural disasters;

WHEREAS, Executive Order (EO) No. 816, series of 2009, declared the River Basin Control Office (RBCO) under the Department of Environment and Natural Resources (DENR) as the lead government agency for the integrated planning, management, rehabilitation and development of the country’s river basins;

WHEREAS, EO No. 815, series of 2009, declared the implementation of the Environmental and Economic Development Program within Laguna Lake as a Presidential priority;

WHEREAS, the President has the continuing authority to rationalize and integrate various mandates of the Executive Branch pursuant to Section 31, Chapter 10, Title III, Book III of the Administrative Code of 1997.

NOW, THEREFORE, I, GLORIA MACAPAGAL-ARROYO, President of the Republic of the Philippines, by virtue of the powers vested in me by law, do hereby order:

Section 1. Laguna Lake Rehabilitation Project – Project Management Office. There is hereby created a Laguna Lake Rehabilitation Project- Project Management Office (LLRP-PMO) to implement the Laguna Lake Rehabilitation Project.

Section 2. Administrative Supervision. The Department of Environment and Natural Resources (DENR), through the River Basin Control Office (RBCO), shall have the direct administrative supervision over the LLRP-PMO.

Section 3. Organizational Structure. The organizational structure of the LLRP-PMO shall be composed of three (3) units:

a. Operations Division

b. Monitoring Division

c. Financial and Administrative Services Division

Section 4. Staffing. The LLRP-PMO shall be staffed with the following:

a. Project Management Officer

b. Deputy Project Management Officer

c. Technical Personnel

d. Support/Non-Technical Personnel

Section 5. Scope of Authority and Responsibility. The LLRP-PMO shall have the following responsibilities:

a. Ensure effective implementation and management of the Laguna Lake Rehabilitation Project;

b. Coordinate, supervise and monitor project activities implemented by the contractor;

c. Provide technical assistance to the contractor on the following areas:

1. Dredging of Laguna Lake Nautical Highway and Napindan Channel;

2. Shoreland reclamation and development;

3. Construction of Ferry Stations and Terminals;

4. Construction of Wastewater treatment plants;

5. Other project components or areas deemed requiring technical assistance from the LLRP-PMO;

d. Validate the contractor’s accomplishments and prepare validation report;

e. Mange and coordinate the implementation of the Project to all concerned national government agencies, private sector and other entities that have stakes in the development and rehabilitation of the lake;

f. Manage the efficient utilization of its Maintenance and Other Operating Expenses (MOOE);

g. Facilitate the coordination and implementation of activities between the different agencies involved in management and development of the Laguna de Bay area;

h. Coordinate and plan with the relevant line agencies and local government units to ensure proper operation and maintenance of the infrastructures to be constructed in the area as per approved feasibility study;

i. Prepare and submit weekly and monthly progress report to the Assistant Secretary of the RBCO;

j. Conduct information, education, communication and advocacy campaign relating to the benefits and advantages of the project to support socio-economic development, ecological restoration and environmental stability of the Laguna Lake Region;

k. Administer its finance and procurement; and

l. Undertake other duties and functions as may be necessary to perform its mandate.

Section 6. Implementation Arrangement. The LLRP-PMO under the DENR-RBCO shall be supported by the Laguna Lake Development Authority (LLDA), an agency under the DENR. All other departments, government agencies and entities concerned are hereby ordered to provide full cooperation for the timely and smooth execution of the program.

Section 7. Budgetary Support. The amount of Twenty Five Million Pesos (P 25,000,000.00) to be sourced from unprogrammed funds of the DENR, and/or as may be recommended and/or approved by the Department of Budget and Management (DBM), shall be released every year to support the operations and administration of the LLRP-PMO under the RBCO to carry out the implementation of the project until its completion.

Section 8. Inter-Agency Cooperation. The departments, bureaus, offices, agencies or instrumentalities, including government-owned or controlled corporations, are hereby directed to extend such assistance and cooperation as the RBCO-LLRP-PMO may need in the discharge of its functions.

Section 9. Repeal. All executive orders, rules and regulations and other issuances or parts thereof, which are inconsistent with this Executive Order, are hereby revoked, amended, or modified accordingly.

Section 10. Effectivity. This Executive Order shall take effect fifteen (15) days after its complete publication in a national newspaper of general circulation and fifteen (15) days after registration with the Office of the National Administrative Register.
