EXECUTIVE ORDER NO. 436 November 22, 1990
DIRECTING MEASURES TO PREVENT EXCESSIVE INCREASES IN PRICES OF CERTAIN PRIME AND ESSENTIAL COMMODITIES AND TO PROTECT THE PEOPLE FROM HOARDING, PROFITEERING, INJURIOUS SPECULATIONS, MANIPULATION OF PRICES, AND OTHER PERNICIOUS PRACTICES IN AREA WHERE A STATE OF PUBLIC CALAMITY HAS BEEN DECLARED DUE TO TYPHOON "RUPING"
WHEREAS, to prevent unreasonable increases in prime and essential commodities and artificial shortages thereof in the areas severely stricken by typhoon "Ruping", and to protect the people from boarding, profiteering, injurious speculations, manipulation of prices and other activities calculated to take advantage of the situation, certain emergency measures must be undertaken;
NOW, THEREFORE, I, CORAZON C. AQUINO, President of the Philippines, by virtue of the powers vested in me by law, do hereby order:
Sec. 1. The Secretary of Trade and Industry is hereby authorized to impose price ceiling on prime and essential commodities in the areas severely stricken by typhoon "Ruping", where a state of public calamity has been declared, and to take much measures as may be appropriate to ensure the availability and reasonable prices of said commodities.
Sec. 2. The prime and essential commodities and their respective price ceiling shall be those recommended by the Emergency Task Forces, composed of government and private sectors representatives, in the calamity stricken areas and approved by the Secretary of Trade and Industry. The list of the prime and essential commodities and their respective price ceilings shall be polished in a local newspaper within the area where the price ceilings approved by the Secretary of Trade and Industry shall be imposed.
Sec. 3. The Secretary of Trade and Industry is hereby authorized to reviews, adjust or revise the aforesaid price ceilings on the prime commodities covered as may be warranted.
Sec. 4. The Department of Trade and Industry is hereby directed to implement this Executive Order and to impose penalties as are provided for under Executive Order No. 913, Series of 1983, without prejudice to criminal and civil prosecutions under applicable laws.
Sec. 5. The Department of Trade and Industry is hereby authorized to mobilize and deputize all government agencies and instrumentalities including the local governments, Philippine Constabulary/Integrated National Police, and other law enforcement agencies to strictly implement this Executive Order.
Sec. 6. The nationwide price ceilings on rice provided for under National Emergency Memorandum Order No. 29 shall remain in force except in the National Capital Region where the price ceilings have been adjusted. Transport and handling add-on cost shall be allowed upon review and approved by the Emergency Task Force.
Sec. 7. The Executive Order shall take effect immediately upon publication in a national newspaper of general circulation and shall remain in effect until revoked.
