MODIFYING THE RATES OF IMPORT DUTY ON CERTAIN IMPORTED ARTICLES AS PROVIDED UNDER THE TARIFF AND CUSTOMS CODE OF 1978, AS AMENDED, IN ORDER TO IMPLEMENT THE DECISIONS OF THE THIRD ASEAN SUMMIT AND THE TWENTY-SEVENTH MEETING OF THE COMMITTEE ON TRADE AND TOURISM TO PROVIDE A MINIMUM LEVEL OF 25% MARGIN OF PREFERENCE TO CERTAIN ITEMS WHICH ARE CONTAINED IN THE PHILIPPINE EXCLUSION LIST AND TO DEEPEN THE MARGIN OF PREFERENCE IN RESPECT OF CERTAIN ITEMS WHICH ARE UNDER THE ASEAN PREFERENTIAL TRADING ARRANGEMENTS (PTA) TO 50 % WITHIN FIVE YEARS
Pursuant to the powers vested in me under Section 402 of the Tariff and Customs of Code of 1978, as amended, I, CORAZON C. AQUINO, President of the Philippines, do hereby order:
Sec. 1. The articles specifically listed in Annex "A" hereof as classified under Section 104 of the Tariff and Customs Code of 1978, as amended, shall be accorded a minimum level of 25% Margin of Preference (MOP) as items being introduced into the ASEAN Preferential Trading Arrangements (PTA) from the Philippine Exclusion List. In effect, such articles shall be subject to the Preferential Tariff for ASEAN in accordance with the schedule indicated in Column 5 of said Annex "A". Items listed in Annex "B" hereof as classified under Section 104 of the Tariff and Customs Code of 1978, as amended, shall be accorded additional Margin of Preference as specified in columns 6, 8, 10, 12 and 14 of said Annex "B". In effect, such articles shall be subject to the Preferential Tariff for ASEAN in accordance with the schedule indicated in Columns 5, 7, 9, 11 and 13 of Annex "B". These concessions were agreed upon during the Third ASEAN Summit and the Twenty-Seventh Meeting of the Committee on Trade and Tourism (COTT).
Sec. 2. In the event that any subsequent changes are made in the basic Philippine rate of duty on any of the abovementioned articles, such articles shall automatically be accorded the corresponding Margins of Preference.
Sec. 3. After the date of effectivity of this Executive Order, all the above-described articles entered or withdrawn from warehouses in the Philippines for consumption shall be subject to the rates of import duty herein prescribed subject to qualification under the Rules of Origin as specified in the Agreement on ASEAN Preferential Trading Arrangements ratified on August 1, 1977.
Sec. 4. This Executive Order shall take effect as of January 1, 1990.
