EXECUTIVE ORDER NO. 357 May 24, 1989
STRENGTHENING THE EXISTING COORDINATING MECHANISM OF THE NATIONAL SHELTER PROGRAM OF THE GOVERNMENT UNDER EXECUTIVE ORDER NO. 90, DATED DECEMBER 17, 1986
WHEREAS, Executive Order No. 90, dated December 17, 1986, identified the government agencies essential for the National Shelter Program and defined their mandates, created the Housing and Urban Development Coordinating Council, and rationalized funding sources and lending mechanisms for home mortgages;
WHEREAS, the key agencies of the National Shelter Program are the National Housing Authority, the National Home Mortgage Finance Corporation, the Housing and Land Use Regulatory Board and the Home Insurance and Guaranty Corporation pursuant to Section 1 of Executive Order No. 90, dated December 17, 1986;
WHEREAS, the support agencies of the National Shelter Program are the Home Development Mutual Fund, Social Security System and the Government Service Insurance System pursuant to Section 2 of Executive Order No. 90, dated December 17, 1986;
WHEREAS, the Housing and Urban Development Coordinating Council was created for the main function of coordinating the activities of the government housing agencies to ensure the accomplishment of the National Shelter Program pursuant to Section 3 of Executive Order No. 90, dated December 17, 1986;
WHEREAS, the Chairman of the Housing and Urban Development Coordinating Council is the ex-officio Chairman of the governing Boards of the key housing agencies pursuant to Section 6 of Executive Order No. 90, dated December 17, 1986;
WHEREAS, for administrative purposes under existing laws, the President of the Philippines is the department head of, and exercises direct control and supervision over, the coordinating, key and support agencies of the National Shelter Program, to wit: Housing and Urban Development Coordinating Council, the National Housing Authority, the National Home Finance Corporation, the Housing and Land Use Regulatory Board, the Home Insurance and Guaranty Corporation, the Home Development Mutual Fund, the Social Security System and the Government Service Insurance System;
WHEREAS, to ensure the accomplishment of the National Shelter Program, it is necessary to strengthen the existing coordinating mechanism of the National Shelter Program by delegating overall administrative supervision over the key housing agencies, namely, the National Housing Authority, the National Home Finance Corporation, the Housing and Land Use Regulatory Board, and the Home Insurance and Guaranty Corporation, to the Housing and Urban Development Coordinating Council acting as the Presidential arm on the National Shelter Program under the direct control and supervision of the President of the Philippines;
WHEREAS, jurisprudence recognizes that the President of the Philippines may delegate some Presidential powers to Presidential subordinates (Lacson-Magallanes Co., Inc. vs. Pano, L-27811, Nov. 17, 1967, 21 SCRA 895);
NOW, THEREFORE, I, CORAZON C. AQUINO, President of the Philippines, by virtue of the powers vested in me by law, do hereby order:
1. The Housing and Urban Development Coordinating Council shall exercise overall administrative supervision over the key housing agencies, namely: the National Housing Authority, the National Home Mortgage Finance Corporation, the Housing and Land Use Regulatory Board, and the Home Insurance and Guaranty Corporation (HIGC), subject to the direct control and supervision of the President of the Philippines;
2. The Housing and Urban Development Coordinating Council shall be responsible for meeting targets and objectives for the housing sector and, together with the key and support housing agencies, achieving these objectives and targets; and
3. The Housing and Urban Development Coordinating Council is specifically directed to undertake the following:
a. Review the organization, programs and projects of the key housing agencies and adopt, through their respective governing boards, such measures as may be necessary and proper to ensure that the activities of these agencies are fully coordinated and integrated;
b. Decentralize its operations and of the key housing agencies by integrating the regional activities of these agencies in order to attain an equitable regional distribution of housing benefits; and
c. Enlist the assistance of the Department of Budget and Management in securing the continuing funding support for the National Shelter Program and to identify and submit to the proper implementating agency projects for funding under the Philippine Assistance Program.
4. This Executive Order shall take effect immediately.
