[ EXECUTIVE ORDER NO. 278, December 08, 1970 ]
AUTHORIZING THE TRANSFER TO PROVINCIAL AND CITY JAILS OF NATIONAL PRISONERS SENTENCED TO NOT MORE THAN THREE YEARS
WHEREAS, modern penology dictates the segregation of prisoners serving short terms from those serving long terms; and
WHEREAS, such desired segregation could not be effected in our national penal institutions due to their highly congested condition;
N0W,THEREFORE, I, FERDINAND E. MARCOS. President of the Philippines, by virtue of the powers vested in me by Section 1722 of the Revised Administrative Code, hereby authorize the Secretary of Justice to transfer as many national prisoners sentenced to a maximum term of not more than three years as may be accommodated by the local jails of their home provinces or cities. The expenses of such transfers and the subsistence of such national prisoners while confined in the local jails shall be borne by the Bureau of Prisons. Escort service for the transfers shall be rendered by the Philippine Constabulary.
The Secretary of Justice is hereby also authorized to promulgate the necessary rules and regulations to carry out this order.
