[ EXECUTIVE ORDER NO. 209, February 10, 1970 ]
AMENDING EXECUTIVE ORDER NUMBERED THREE HUNDRED AND TWO DATED MAY FIVE, NINETEEN HUNDRED AND FIFTY-EIGHT
Pursuant to the authority conferred upon me by the Constitution and existing laws, I, FERDINAND E. MARCOS, President of the Philippines, do hereby amend Executive Order No. 302, dated May 5, 1958, by inserting the following provision as paragraph 7a in said Executive Order:
“7a. For every case referred to and/or taken cognizance of by the Efficiency and Separation Board involving a specific act of misconduct or moral turpitude, the Commander of the command to which the Efficiency and Separation Board pertains shall designate or appoint a prosecuting officer. It shall be his duty to prosecute the case before the Efficiency and Separation Board by gathering and presenting evidence of alleged misconduct, inefficiency, or unfitness against the respondent officer, and refuting his defense. If the case of the officer concerned is elevated to the Board of Review as provided hereunder, the same prosecuting officer shall continue to perform his duties as such in regard to the particular case pending before said Board unless due to his inability, the Commander concerned designates another prosecuting officer in the review proceedings.”
