SUPREME COURT CIRCULARS AND ORDERS
TO: ALL CLERKS OF COURT AND EX-OFICIO SHERIFFS OF THE REGIONAL TRIAL COURTS
In view of the prohibitive cost of publication, a request was filed with this Court for the revision and/or modification of the Notice of Sale of Extra-Judicial Foreclosure Petition filed with the Sheriff's Offices for publication in newspapers. It proposes to eliminate, for reason of economy, some words or phrases which are of less importance but still will comply substantially with Act 3135.
Pursuant therefore to the Resolution of the Court En Banc, dated April 3, 1984, you are hereby DIRECTED to adopt the following format:
NOTICE OF EXTRA-JUDICIAL SALE
Upon extra-judicial petition for safe under Act 3135 _________ filed by ______ against (Name and address of Mortgagor/s) to satisfy the mortgage indebtedness which as of ___________ amounts to P_________, excluding penalties, charges, attorney's fees and expenses of foreclosure, the undersigned or his duly authorized deputy will sell at public auction on date of sale 198 _____ at 10:00 A.M. or soon thereafter at the main entrance of the Place of Sale) to the highest bidder, for cash and in Philippine currency, the following property with all its improvements, to wit:
TRANSFER CERTIFICATE OF TITLE NO. _____
A parcel of land . . . . . . . . . . . situated in . . . containing an area . . ., more or less. . . .
Prospective buyers may investigate for themselves the title hereinabove described and encumbrances thereon, if any there be.
