Begun and held in Cotabato City on Monday, the twenty-fourth day of October two thousand five.

AN ACT CREATING THE MUNICIPALITY OF DATU BLAH T. SINSUAT IN THE PROVINCE OF MAGUINDANAO, PROVIDING FUNDS THERFOR, AND FOR OTHER PURPOSES.

Be it enacted by the Regional Assembly in session assembled:

Section 1. Barangays Kinimi, Laguitan, Lapaken, Matuber, Meti, Nalkan, Penansaran, Sedem, Sinipak, Resa, Tambak and Tubuan in the Municipality of Upi are hereby separated from said municipality and constituted into an independent municipality, which is hereby created, to be known as the Municipality of Datu Blah T. Sinsuat, without affecting in any manner the legal existence of the Municipality of Upi.

The seat of government of the new municipality shall be in Barangay Kinimi, which shall likewise be known as the Poblacion.

Sec. 2. The territorial jurisdiction of the Municipality of Datu Blah T. Sinsuat shall be bounded as follows:

Sec. 3. Within sixty (60) days after ratification by the majority of votes cast in a plebiscite supervised by the Commission on Elections to be conducted in the affected area of the present Municipality of Upi within a period of ninety (90) days after the approval of this Act, the Regional Governor shall appoint the mayor and other officials to hold elective positions in the new Municipality of Datu Blah T. Sinsuat.

Sec. 4. The new municipality shall acquire corporate existence upon the appointment and qualification of the first mayor and the majority of the members of the Sangguniang Bayan.

Sectoral members of the Sangguniang Bayan may be appointed as well in accordance with Muslim Mindanao Autonomy Act No. 25 although it has no effect or bearing on the corporate existence of the municipality.

Sec. 5. Any part or provisions of this Act is separable but the other parts or provisions that shall not be affected thereby will remain valid and legal.

In addition thereto, all laws, executive orders, rules and regulations, or parts thereof, that are inconsistent with the provisions of this Act are hereby repealed or amended accordingly.

Sec. 6. The expenses in holding the plebiscite provided in Section 3 hereof shall be taken out of available funds in the treasury of the Municipality of Upi, not otherwise appropriated, during the current fiscal year.

Sec. 7. This Act shall take effect upon its approval.
